MINUTES <br />CITY COUNCIL <br />J[JI~Y 13, 1994 <br />FIRE HYDRANT Mr. Dick Boss, 57 Bryan Avenue, appeared before the <br />RELOCATION Council requesting City participation in the cost of <br />relocating a fire hydrant on Bryan Avenue. Boss <br />reported that in 1985 he purchased the Stokke property <br />on Bryan Avenue and divided it into five lots. As part <br />of the platting process, it was discovered that a <br />portion of Bryan Street and Jackson Street encroaahed <br />onto the Boss property. This encroachment included <br />utilities as well. It was also discovered that there <br />were only four sewer and water stubs to the property, <br />therefore, a fifth had to be installed. There was also <br />some discussion at the time that the hydrant location <br />could be a problem in the future. Boss reported that <br />in return for the City's installing the additional <br />sewer and water stubs, he dedicated additional road and <br />utility easements. <br />Boss reported that his son is constructing a house on <br />Bryan Avenue, and the hydrant falls riqht in the middle <br />of his driveway. Therefore, it is necessary that the <br />hydrant be moved. <br />Boss reported that he has discussed the hydrant <br />relocation with the Public Works Superintendent, who <br />has informed him that the City's policy has been that <br />the cost of relocation is usually borne by the property <br />owner. Boss felt that given the circumstances, the <br />City should share in this cost. <br />Pedersen asked if the house could have been positioned <br />on the lot so that the hydrant would not have <br />interfered with the driveway. <br />Boss reported that the hydrant falls right in the <br />middle of the lot, therefore, it would have been a <br />problem no matter how the house was positioned. <br />Morelan asked if the City Administrator was familiar <br />with the easements Mr. Boss granted the City. <br />The City Administrator assumed that these easements <br />were required as part of plat approval. <br />Boss replied that that was correct. <br />Morelan asked what rights Boss retains over the land <br />even though easements have been granted. <br />3 <br />
