MIN[PPES <br />CITY COUNCIL <br />FEBRUARY 9, 1994 <br />be prudent to spend $11,000 per year for this type of <br />coverage. <br />Scalze asked about the $500 premium for coverage for <br />violations to the open meeting law. <br />The City Administrator reported that this coverage <br />would provide 80~ of defense costs for charges of open <br />meeting law violation. The Administrator reported that <br />there have been cases where individuals have had to <br />spend $10,000 to $20,000 defending these kinds of <br />charges. <br />Morelan pointed out that while none of the Council <br />would knowingly violate the open meeting law, there is <br />enough grey area where a challenge could occur. <br />The City Administrator pointed out that while the fine <br />for violation of the open meeting law is minimal, there <br />may be circumstances where the Council would want to <br />defend against such an accusation. The City Attorney <br />stated that the third violation of the open meeting law <br />results in the Council Member being expelled from <br />office. The Attorney felt that the price for the <br />coverage appeared to justified. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 94-2-39 - ADOPTING AND APPROVING THE <br />1994 INSURANCE RENEWALS AS PRESENTED BY THE CITY <br />ADMINISTRATOR INCLUDING THE ADDITION OF OPEN MEETING <br />LAW COVERAGE, AN INCREASE IN DEDUCTIBLE FOR ALL CLAIMS <br />FROM $250 TO $500, AND EXCLUDING UMBRELLA COVERAGE <br />The foreqoing resolution was duly seconded by Scalze. <br />Ayes (4) Morelan, Scalze, Aanson, Pedersen. <br />Nays (0). Resolution declared adopted. <br />FALSE The City Administrator presented a proposed revision <br />~I.~RM to the City's False Alarm Ordinance which increases <br />ORDINANCE the fine schedule for false burglar alarms so that a <br />fine of $50 is charged beginning with the third false <br />alarm through the sixth. Seven or more false burglar <br />alarms would be charged at $200 per false alarm. False <br />fire alarms would be charged at $250 for the third and <br />fourth false alarm, and $500 for the fifth and <br />subsequent false alarms. Another major change is that <br />after 6 false burglar alarms and 4 false fire alarms, <br />the City is requiring that a report be submitted <br />outlining the efforts that have been made to repair the <br />alarm system. If such a report or action plan has not <br />been submitted within 15 days, the property owner would <br />be charged with a misdemeanor for continued existence <br />of a hazard. <br />Page 13 <br />
