MINUTE5 <br />CITY COUNCIL <br />AUGUST 10, 1994 <br />The City Administrator pointed out that there is a <br />height issue involved with the walls. <br />Morelan asked if there has ever been anyone hurt on the <br />walls. <br />Desai replied that a couple of neighborhood kids did <br />fall off the walls a couple of years ago. <br />Hanson suggested that if the City has any liability <br />exposure, it was leaving itself open to problems. <br />Pedersen asked if there is no homeowners' association, <br />whose responsibility the walls were. <br />The City Administrator replied that he assumed there <br />was a Dianna Lane homeowners' association, but there <br />appears not to be. If there is no formal group in <br />place to oversee an improvement project, it would be <br />important that the City become involved. The issue is <br />who will pay for a project. <br />LaValle stated that if the walls are on City property <br />and are unsafe, the City should correct the problem by <br />either improving the walls, or removing them and <br />regrading the area. LaValle stated that he did not <br />want to spend tax dollars to repair something that was <br />not owned by the City. However, the fact is that the <br />walls are deteriorating and becoming unsafe. LaValle <br />suggested that staff put together some options for <br />correcting the problem as well as cost estimates. <br />Pedersen asked if an improvement to the walls should be <br />paid for from the General Fund or assessed to the <br />Dianna Lane residents. <br />Scalze pointed out that the walls would benefit Dianna <br />Lane properties as they are the entry marker to the <br />road. <br />The City Attorney suggested that whether the walls are <br />located within the road right-of-way should be <br />determined. <br />The City Administrator also pointed out that another <br />issue to resolve is what constitutes a repair.
