MINUTES <br />CITY COUNCIL <br />AUGUST 24, 1994 <br />Dennis Ashbach, Canabury Pond Townhome Association, <br />reported that the Association contacted the DNR about <br />managing the geese. The DNR will remove the geese for <br />a fee, but will not guarantee that they will not <br />return. As a result, the fencing alternative was <br />developed. Ashbach reported that he lives on the <br />second floor of the townhomes and he and his wife have <br />an escape route in the event of a fire. Ashbach also <br />reported that he wife had polio as a child and has a <br />congenital hip defect and has no trouble with stepping <br />over the fence. Ashbach also indicated that in the <br />event of a fire, he was sure that residents would help <br />each other over the fence and also pointed out that the <br />fence could easily be torn down. Ashbach reported that <br />the property owners have put a lot of money into the <br />lawn adjacent to the pond and would like to keep it <br />usable. <br />Scalze asked if the fence issue should be sent to the <br />Fire Chief for comment. <br />Morelan did not think so given the temporary nature of <br />the fence. However, if the fence were of a more <br />permanent construction, then some gate system or means <br />to allow egress would have to be considered. <br />A resident of the townhomes indicated that the fence <br />would be removed in the fall when the geese leave and <br />put up again in the spring when they return. <br />There was no one else from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Scalze, the public <br />hearing was closed. <br />The Council discussed whether to approve the CUP for a <br />special use fence or amend the ordinance to make such <br />fences permitted uses. It was the consensus of the <br />Council that the City Planner should prepare an <br />ordinance amendment that would permit these types of <br />fences. Therefore, a Conditional Use Permit approval <br />in this instance would be unnecessary. <br />LaValle asked if the City had any liability for such <br />temporary fencing. <br />The City Attorney replied that the City did not have <br />15 <br />
