MINUTES <br />CITY COUNCIL <br />AUGUST 24, 1994 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 94-8-224 - INSTRUCTING CITY STAFF TO <br />SURVEY TFIE SURROUNDING CITIES (TWO CITIES DEEP) TO <br />DETERMINE IF THEY ARE CHARGING USER FEES IN LIEU OF <br />PROPERTY TAXES FOR CELLULAR TRANSMISSION TOWERS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Hanson, Morelan, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CUP FOR Hanson opened the public hearing to consider an <br />SPECIAL application for Conditional Use Permit for special <br />USE FENCE - use fence to control access by geese to townhome <br />CANABURY property as requested by Canabury Pond Townhomes at <br />POND 175 East County Road B-2. The Planning Commission <br />TOWNHOMES recommended denial of the CUP. <br />LaValle suggested that the Ordinance be amended to <br />allow fences for such things as around gardens, <br />controlling wildlife and snowfencing. LaValle also <br />suggested that the application fee for this Conditional <br />Use Permit be refunded to Canabury Pond Townhomes. <br />Scalze reported that the fence is barely visible and <br />felt it should be allowed. <br />Robert Iser, 160 East County Road B-2, indicated that <br />he opposed a fence in the front yard along County Road <br />B-2. Iser felt a better alternative would be to look <br />into ways to remove the geese from the area. <br />One of the townhome residents explained the location of <br />the fence along the pond in the back of the property. <br />Once that location was known, Iser indicated that he <br />had no objections to the fence. <br />Morelan stated that the issue is whether the Ordinance <br />should be revised so that the fence is an allowed use. <br />Morelan asked if the fence would hamper egress from the <br />building in the case of a fire. <br />14 <br />
