The Building Inspector issued McCumber a <br />building permit for the fence, but the City upheld the <br />Conditional Use Permit requirement for a wooden privacy <br />fence. The issue went to court, but the City dropped <br />the lawsuit because its position was compromised since <br />the Building Inspector issued the building permit. <br />Therefore, the cyclone fence exists and now Mr. <br />McCumber has put barbed wire on top of that fence. <br />Jackson stated that it was his feeling that Mr. <br />McCUmber had a requirement to screen his property from <br />the adjacent residential property, and the chain-link <br />fence does not provide screening. Jackson stated that <br />he further objected to the barbed wire on top of the <br />fence. Jackson acknowledqed that Mr. McCumber has <br />experienced significant losses due to theft, and stated <br />that it was not his intention to try to prevent <br />McCumber from protecting his property. Jackson felt <br />that could be done while still providing screening for <br />the adjacent residential properties. Jackson reported <br />that he planted some pine trees along the fence. They <br />are currently five feet in height, and in a few years <br />should screen the area. However, in the interim <br />Jackson requested some help. Jackson pointed out that <br />barbed wire on top of the chain-link fence does nothing <br />to add to the aesthetics of the area. Ideally, Jackson <br />would prefer a wooden fence, but felt at a minimum <br />vines should be planted along the chain-link fence to <br />provide some screening. <br />The City Planner reported that the chain-link fence has <br />slats in it which is an allowable screening material <br />under the current ordinance. <br />McCumber reported that when he first applied for a CUP <br />15 to 17 years ago, he was told that this is the type <br />of fence to put up. The residential builder in the <br />area approached him and asked if a wooden fence could <br />be installed instead. McCumber agreed, the residential <br />builder installed the wooden fence, and the first storm <br />that came along blew down the fence. McCumber reported <br />that he then replaced the wooden fence with a chain- <br />link one. <br />The City Planner reported that the current ordinance <br />requires that Industrial property adjacent to <br />Residential screen outdoor storage areas. <br />3 <br />
