MINUTES <br />CITY COUNCIL <br />SEPTEMBER 28, 1994 <br />PERMIT FOR SPECIAL PURPOSE FENCE ALLOWING BARBED WIRE <br />ON TOP OF A STORAGE ENCLOSURE FENCE WHICH IS ADJACENT <br />TO A RESIDENTIAL AREA AS REQUESTED BY MR. ED MCCUMBER <br />FOR PROPERTY LOCATED AT 608 EAST COUNTY ROAD D WITH THE <br />HOPE THAT MR. MCCUMBER AND MR. JACKSON WILL GET <br />TOGETHER AND JOINTLY PLANT SOME VINES WHICH WILL <br />EVENTUALLY PROVIDE SCREENING OF TI-IE BARBED WIRE <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Aanson, <br />Nays (2) Scalze, Morelan. Resolution denied. <br />Hanson pointed out that it takes four affirmative votes <br />of the City Council to approve a Conditional Use <br />Permit. <br />The City Attorney replied that that was correct, <br />therefore, the property owner did not have a <br />Conditional Use Permit. The Attorney stated that he <br />would have to check the facts and determine the course <br />of action that is available to the City. <br />Hanson pointed out that the barbed wire is in violation <br />of the Ordinance without the CUP. Hanson agreed with <br />previous comments about the spot zoning of the <br />property. Hanson asked if the Council was willing to <br />aggressively pursue other similar situations in the <br />City. Hanson pointed out that there is barbed wire on <br />the fence around the City's water tower. The City <br />Center property abuts residential property. <br />Scalze suggested that the City Administrator research <br />the matter of the barbed wire around the water tower <br />and report his findings to the Council. <br />The City Administrator pointed out that the water tower <br />was constructed in 1978 or 1979 and the ordinance <br />addressing barbed wire on fencing adjacent to <br />residential property may have come into effect after <br />that time. Therefore, the fence may not have been in <br />violation of any ordinances at the time it was <br />constructed. Similar to the fact that the McCumber <br />screening fence is now in compliance with the Code <br />since the Code was amended after the fence was <br />installed allowing chain-link with slats as a screening <br />material. <br />LaValle pointed out that the Sheriff's Department made <br />9 <br />
