LaValle also pointed out that the barbed <br />wire is not objectionable to two of the three adjacent <br />property owners. LaValle felt that the City had to <br />give some weight to the recommendation of the Sheriff's <br />Department, and similarly the Fire Department when they <br />make recommendations. <br />Scalze suggested that perhaps the Code is wrong and <br />should be amended. Scalze suggested that the Sheriff's <br />Department make a recommendation on the Code itself. <br />LaValle pointed out that the problem would not exist if <br />it were not for the spot zoning. <br />Scalze noted that the Code was amended in 1980 after a <br />great many meetings. However, if the Code is wrong, it <br />should be changed. <br />Hanson pointed out that the City Garage is located on <br />property zoned Industrial, but abuts residential <br />development. <br />Morelan pointed out that it is the barbed wire on top <br />of the fence which is in violation of the Code. <br />Morelan also noted that the request does not meet the <br />criteria necessary for approving a CUP. If the Council <br />feels the barbed wire should be allowed, the Code <br />should be changed rather than approving a CUP. <br />Pedersen again pointed out that the problem is the spot <br />zoning. <br />Scalze noted that Slumberland abuts residential <br />property. <br />Pedersen stated that at some point the matter must be <br />decided by using common sense. Pedersen felt that the <br />Sheriff has been at the site responding to calls and <br />understands the problem that exists there. <br />Scalze noted that Sailboard Warehouse abuts residential <br />and pointed out that the City could receive the same <br />request from any property in a similar situation. <br />Scalze suggested that perhaps the Code should be <br />changed. <br />The City Planner reported that the Code allows barbed <br />10 <br />
