MINUTES <br />CITY COUNCIL <br />OCTOBER 26, 1994 <br />CODE OF THE CITY OF LITTLE CANADA, SECTION 903.020, <br />REGARDING TEMPORARY SPECIAL PURPOSE FENCES WIiICH <br />PROVIDE PROTECTION FROM NATURAL ELEMENTS <br />The foregoing ordinance was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Hanson, LaValle, Pedersen. <br />Nays (0). Ordinance declared adopted. <br />BOUNDARY Hanson opened the public hearing to consider amending <br />LINE FENCES the Code relating to boundary line fencing. The <br />ordinance amendment requires that a property owner <br />obtain the written permission of his neighbor in order <br />to place a boundary line fence on the property line. <br />If such permission cannot be obtained, the fence would <br />have to be placed three feet from the property line. <br />Morelan stated the City has an aqreement form that <br />property owners could use to obtain their neighbor's <br />permission. A copy of the form would have to be <br />submitted at the time building permit application was <br />made in order for the Building Official to approve <br />placement of the fence on the property line. <br />Mark Peckman, 2560 Edgerton Street, asked if boundary <br />line fences currently on property lines without <br />permission of the adjacent property owner would be <br />grandfathered in. <br />Morelan replied that these fences would be <br />grandfathered in, however, if there was the need to <br />reconstruct, permission of the adjacent property owner <br />would have to be obtained, or the fence would have to <br />be brought into conformance with the Code. <br />Peckman asked if a building permit was always required <br />for a boundary line fence. <br />The City Administrator was not sure when the <br />requirement for a buildinq permit came into effect, <br />however, a building permit for fences has been required <br />for quite some time. <br />Peckman was concerned about an existing fence which <br />might not meet Code. <br />Morelan suggested if there is a specific situation that <br />exists that Peckman has concerns with, he should <br />10 <br />
