MINUTES <br />CITY COUNCIL <br />OCTOBER 26, 1994 <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Pedersen, the <br />public hearing was closed. <br />Morelan noted that the public hearing notice referred <br />to the request for rezoning of 2626 McMenemy from B-3 <br />to R-3. Morelan asked if it was acceptable to rezone <br />to RB under this hearing notice. <br />The City Attorney replied that this was allowable under <br />the Code since the RB zoning is an interim step between <br />R-3 and B-3. However, suggested that Mr. Rossez submit <br />a letter indicating that he concurs with the rezoning <br />of the property to RB. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-10-371 - APPROVING THE REZONING OF <br />2626 McMENEMY ROAD FROM B-3 (GENERAL BUSINESS) TO RB <br />(RESIDENTIAL BUSINESS) SUBJECT TO RECEIPT OF A LETTER <br />FROM MR. ROSSEZ INDICATING TAAT THE RB ZONING IS <br />SATISFACTORY AS PER THE RECOMMENDATION OF TfiE CITY <br />ATTORNEY, AND INSTRUCTING THE CITY ATTORNEY TO PREPARE <br />THE APPROPRIATE ORDINANCE AMENDMENT REZONING THE <br />PROPERTY TO RB <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />5PECIAL Hanson opened the public hearing to consider an <br />PURPOSE ordinance amending the Code to allow special purpose <br />FENCES fences which provide protection from natural elements. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by Morelan, seconded by Scalze, the public <br />hearing was closed. <br />Mr. Morelan introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 389 - AN ORDINANCE AMENDING THE MUNICIPAL <br />9 <br />
