MIN[]TES <br />CITY COUNCIL <br />NOVENIBER 23, 1994 <br />against a developer. The award to the developer was a <br />substantial one. Lancette stated that he had two <br />questions for the Council. The first is who pays the <br />bill if the City of Little Canada is sued and there is <br />an award against the City. The second question is who <br />represents the City of Little Canada in a lawsuit. <br />The City Attorney replied that to the extent that the <br />claim relates to the City's risk coverage, the City's <br />insurance carrier, the League of Minnesota Cities <br />Insurance Trust, would defend the City. The insurance <br />company would pay any judgement awarded against the <br />City for any risk covered by the City's insurance <br />policy. The attorney defending the City would be <br />designated by the League Trust. <br />CONSENT Mr. LaValle introduced the following resolution and <br />AGENDA moved its adoption: <br />RESOLUTION N0. 94-11-409 - APPROVING THE CONSENT AGENDA <br />WHICH CONTAINS THE FOLLOWING ITEMS: <br />*APPROVAL OF ASSESSMENT REAPPORTIONMENT FOR 480 COSTA <br />LANE AS RECOMMENDED BY CITY STAFF; <br />*APPROVAL OF 1994 AUDIT CONTRACT AS PRESENTED AND <br />AUTHORIZING TIIE MAYOR AND CITY ADMINISTRATOR TO <br />EXECUTE ON BEI3ALF OF THE CITY~ <br />*APPROVAL OF THE VOUCHERS <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Hanson, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CLOSED Mr. LaValle introduced the following resolution and <br />SESSION moved its adoption: <br />RESOLUTION NO. 94-11-410 - CALLING FOR A CLOSED SESSION <br />FOLLOWING THIS EVENING'S REGULAR MEETING TO DISCUSS THE <br />MOVERS WAREHOUSE LITIGATION AS WELL AS THE BECKER <br />ASSESSMENT APPEAL AS REQUESTED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Hanson, Pedersen. <br />Nays (0).
