MINUTES <br />CITY COUNCIL <br />NOVEhIBER 23, 1994 <br />services of the Dispute Resolution Center to these <br />property owners which is predicated on the property <br />owners' willingness to sit down and resolve their <br />problems. The Administrator pointed out that this <br />problem has been before the Council in 1989 or 1990 and <br />has been on-going. The City's numerous efforts to <br />resolve the problem have been unsuccessful. <br />Schmidt stated that he holds a Torrens title to his <br />property and stated that the City's Building Official <br />was aware of this. <br />The City Administrator replied that the City does not <br />enforce either Torrens or Abstract property. That is a <br />civil issue. <br />Schmidt pointed out that when someone seizes control of <br />his property, the City will not say whether this is <br />criminal or civil. <br />The City Administrator pointed out that the driveway is <br />of record and the County is considering the driveway to <br />be grandfathered in at this time. The County has also <br />indicated that they will re-look at the issue when <br />Keller Parkway is improved. <br />Hanson suggested that the City offer the services of <br />the Dispute Resolution Center to Mr. Schmidt and his <br />neighbor. Dispute Resolution Center would then <br />contact the two parties to try to establish a meeting <br />between them. <br />Schmidt indicated that he was agreeable. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 94-11-408 - INSTRUCTING THE CITY <br />ADMINISTRATOR TO CONTACT DISPUTE RESOLUTION CENTER AND <br />ASK THEM TO ATTEMPT TO MEDIATE THE SCHMIDT/RYAN DISPUTE <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Hanson, Pedersen. <br />Nays (0).
