MINUTES <br />CITY COUNCIL <br />DECEMBER 21, 1994 <br />Morelan pointed out that a 50 foot street right-of-way <br />for Jackson would put the pavement further away from <br />his house. <br />Scalze pointed out that the street pavement can be <br />placed anywhere within the road easement. <br />Morelan disagreed, indicating that a minimum boulevard <br />of 9 feet would be required. <br />Scalze pointed out the Engineer's recommendation for a <br />28 foot width, and stated that she felt a 28 foot <br />pavement was too wide on a 40 foot right-of-way. <br />The City Engineer stated that the 28 foot pavement <br />width allows room on the street for pedestrian traffic. <br />Scalze pointed out that it appears a 7 foot by 10 foot <br />strip would be necessary from the Magnuson property, in <br />addition to a dedication from the Tima property, in <br />order to assemble a 40 foot street right- of-way for <br />Jackson Street. <br />Berniece Magnuson stated that they would have no <br />problem making that dedication toward the Jackson <br />Street right-of-way. <br />The City Administrator pointed out that the options in <br />assembling the necessary right-of-way is that the <br />property owners dedicate or sell the right-of-way to <br />the City, or the City has the option of condemnation. <br />Lendway asked if a public hearing would be held before <br />a final decision is made. <br />The City Administrator reported that the City is <br />required to hold an improvement hearing to consider and <br />act on the type of improvement which would be made, and <br />then an assessment hearing at which division of the <br />cost of the project would be decided upon. <br />Lendway reported that at the neighborhood meeting the <br />majority of the property owners indicated their <br />opposition to the improvement of Jackson Street and <br />left that meeting with the impression that the cul-de- <br />sac option would be approved if any improvement were to <br />be made. Lendway was concerned that these property <br />owners have the opportunity for additional input before <br />17 <br />
