MINUTES <br />CITY COUNCIL <br />DECENIBER 21, 1994 <br />resolve the problem and get the property on the tax <br />rolls. Scalze stated that it seems like the connecting <br />street is the best way to go, and pointed out that Mr. <br />Tima is willing to dedicate additional right-of-way for <br />Jackson Street. Scalze felt the street connection was <br />in the best interests of public safety and public <br />works. However, Scalze stated that she could <br />understand Morelan's position on the matter and would <br />feel the same way if she lived where he did. <br />Pedersen stated that given the existing road right-of- <br />way it made more sense from a planning standpoint to <br />proceed with the street connection. No matter which <br />option is chosen, the situation will be substandard, <br />but Pedersen pointed out that the street connection is <br />closer to standard. <br />Morelan stated that the 33 feet of Jackson Street road <br />right-of-way has existed for a long time, and was there <br />when he bought his property 15 years ago. Morelan <br />indicated that at the time he purchased the property, <br />he knew the City's standard was 50 feet for residential <br />road right-of-way. Since only 33 feet existed and it <br />unlikely that an additional 17 feet would be dedicated, <br />he was confident that the road would never be improved. <br />Morelan stated that one of the major reasons he <br />purchased his property was that it was on a dead-end <br />street. Morelan also indicated that a year ago he put <br />an addition onto his home after weighing these same <br />factors and coming to the conclusion that the road <br />would not change. Morelan pointed out that the City's <br />standard for a residential road is a 50 foot right-of- <br />way, and he would be opposed to a 40 foot right-of-way <br />for Jackson Street. <br />Scalze asked how Morelan would feel about a 60 foot <br />right-of-way for a cul-de-sac. <br />Morelan replied that he would have no problem with <br />that, but would expect to be reimbursed for the loss of <br />a lot should the cul-de-sac improvement make his <br />property substandard to divide. <br />Scalze pointed out that the Australian right-of-way is <br />40 feet wide, and suggested that width could be <br />continued for Jackson Street. Scalze felt that if the <br />cul-de-sac option is chosen, the right-of-way for the <br />cul-de-sac be a minimum of 60 feet. <br />16 <br />
