MINUTES <br />CITY COUNCIL <br />JANUARY 11, 1995 <br />Morelan, 109 Bluwood Avenue, indicated that he would be <br />addressing the Mayor and Council as a property owner <br />from the area. Morelan felt that there would be <br />additional right-of-way needed at the north and south <br />ends of Jackson Street, and stated that he wanted to <br />know how that right-of-way would impact setbacks for <br />existing homes. Morelan indicated that at the last <br />meeting the Council asked that the cost of the cul-de- <br />sac options be put together based on a equal taking <br />from the 3 or 4 properties involved. Morelan felt <br />there may be a better way to lay out the right-of-way <br />than to take it equally from the abutting properties, <br />and suggested that that option be explored as well. <br />Scalze stated that she would not be in favor of Mr. <br />Tima bearing the entire burden. <br />Fahey asked if it would be less expensive to run one <br />condemnation proceeding than four. <br />The City Attorney replied that that was correct. <br />Morelan pointed out that he has a dividable lot and if <br />any property is taken from him, his lot would no longer <br />be dividable. Therefore, it may be less expensive for <br />the City to take right-of-way from the other abutting <br />properties. <br />Fahey pointed out that if the City took right-of-way <br />from the Morelan property, it could also grant a <br />variance from minimum lot size requirements so that the <br />lot would still be dividable. <br />The City Administrator reported that staff will make <br />their best effort to put costs together on the various <br />options on a per parcel basis. However, there are a <br />great many variables involved. <br />Kajalski again stated that Mr. Tima will be applying <br />for a lot split within the next few days, and the lot <br />split could proceed no matter which option is chosen. <br />Kajalski pointed out that the City Planner, City <br />Engineer, and City Administrator have indicated that <br />the improvement of Jackson Street is the best option, <br />versus substandard cul-de-sacs. Kajalski reported that <br />Mr. Tima's concern is that the City will resort to <br />condemnation which will cause him to lose the ability <br />to divide his property.
