MINUTES <br />CITY COUNCIL <br />JANUARY 25, 1995 <br />AUSTRALIAN/ <br />BLUWOOD <br />STREET & <br />CUL-DE-SAC <br />OPTIONS <br />the City of Little Canada. The Attorney requested a <br />closed session following the Council meeting to discuss <br />any additional activity that may occur. <br />Fahey pointed out the result of this motion and order <br />is that the City is fully vindicated in the Mover's <br />Warehouse litigation against the City. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 95-1-29 - CALLING FOR A CLOSED SESSION <br />FOLLOWING THE COUNCIL MEETING TO DISCUSS THE MOVER'S <br />WAREHOUSE LITIGATION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Morelan, LaValle, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Fahey noted that Council Member Morelan will not <br />participate in any discussion of this matter as a <br />Council Member, but rather as an interested property <br />owner. <br />Fahey referred to staff~s report dated January 23, 1995 <br />and indicated that the net result of that report is <br />that if Mr. and Mrs. Morelan are willing to exchange <br />right-of-way on Australian, a 30-foot radius paved cul- <br />de-sac should be constructed at the end of Australian <br />within the existing right-of-way and that to be <br />dedicated by the Morelan's. <br />The City Administrator reported that the right-of-way <br />at the end of Australian would have a 35 foot radius. <br />The actual pavement would be a 30 foot radius. <br />Adequate right-of-way exists at the end of Bluwood for <br />a cul-de-sac improvement. <br />Scalze asked why the City would improve a 30 foot paved <br />cul-de-sac at the end of Bluwood rather than the <br />standard 45 feet when adequate right-of-way exists. <br />The Administrator reported that there is 90 feet of <br />right-of-way at the end of Bluwood. The City should <br />have at least a five foot cushion between the pavement <br />and edge of the right-of-way for snow storage. The <br />Administrator also suggested that there would be <br />15 <br />
