If the <br />Morelan property can be obtained in exchange for <br />vacated Jackson Street right-of-way, that may make the <br />cul-de-sac option the most feasible. <br />Steve Morelan, 109 Bluwood, stated that they would be <br />willing to look at the possibility of a land trade. <br />Morelan indicated that he would have to look at the <br />effect of the dedication of right-of-way on his <br />property as well as how much property would come back <br />to him as a result of the vacation of Jackson Street. <br />Fahey pointed out that the right-of-way could be taken <br />from the Morelan property with the understanding that <br />he would be left with a buildable lot. <br />Morelan stated that he was interested in seeing how <br />setbacks would affect that buildable lot under the cul- <br />de-sac option. <br />The City Administrator pointed out that figure #7 of <br />his January 23rd report shows that 861 square feet of <br />property would be needed from the Morelan lot for the <br />Australian cul-de-sac. <br />Fahey stated that the City needs a definite answer on <br />this issue since there needs to be access to the Tima <br />property before an application for property division <br />can go forward. If the Council supports staff's <br />recommendation, it should be contingent upon the <br />dedication of easements in exchange for the land trade. <br />Fahey suggested if the cul-de-sac option is not <br />workable, then the Council will have to proceed to a <br />different option. Fahey noted that the City can obtain <br />the necessary right-of-way today, but the improvement <br />does not have to proceed until some time in the future. <br />Larry Stevens, attorney representing Mr. Tima, referred <br />to the City Administrator's January 6th memo, and <br />stated that the primary goal at that time was to <br />utilize the existing Jackson Street right-of-way. The <br />January 23rd memo indicated that figure #7 is the <br />primary objective. Stevens stated that it was his <br />understanding that figure #7 would result in the <br />Jackson Street right-of-way being vacated with the City <br />retaining drainage, utility, and walkway easements. <br />Stevens asked if the vacation of the remaining right- <br />of-way would be used to compensate Mr. Morelan for <br />17 <br />
