MINUTES <br />CITY COUNCIL <br />JANUARY 25, 1995 <br />dedication of an easement for the Australian cul-de- <br />sac. <br />The City Administrator replied that those details have <br />not been worked out as of yet. <br />Stevens asked if that were the case, would compensation <br />be on a per square foot basis. <br />The Administrator estimated that 861 square feet would <br />be needed from the Morelan property for Australian <br />right-of-way and that 1,170 square feet could be <br />vacation from the Jackson Street right-of-way. <br />Stevens asked if Morelan dedicated that 861 square <br />feet, if no dedication would then be needed from the <br />Tima property. <br />The Administrator replied that that was correct. <br />Stevens asked what the City was looking for from Mr. <br />Tima at this point. <br />Fahey replied that until the issue is resolved as to <br />whether or not Mr. Morelan will dedicate the 861 square <br />feet, the Tima lot split request cannot be processed. <br />Stevens stated that Mr. Tima's first preference is to <br />utilize the existing Jackson Street right-of-way. If <br />the purpose of the road connection or cul-de-sac is to <br />improve utility vehicle access, the 35 foot versus 45 <br />foot cul-de-sac may or may not be adequate. Stevens <br />suggested that a 40 foot road right-of-way may be the <br />least expensive alternative. If that does not happen, <br />Mr. Tima will not object to the cul-de-sac improvement <br />as proposed in figure #7. Stevens noted that should <br />Jackson Street be vacated, the neighbors would like to <br />ensure that a walkway easement be retained. Stevens <br />indicated that Mr. Tima would have no objection to the <br />vacation of 13 feet of Jackson Street to compensate Mr. <br />Morelan for dedicating cul-de-sac right-of-way. <br />Scalze felt that from a cost standpoint the improvement <br />of Jackson Street would be the least expensive. <br />However, four votes would be needed to order that <br />improvement, and the Mayor has indicated that he will <br />not support that option. <br />18 <br />
