MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 1995 <br />sketch and not definitive. <br />Fahey asked if the County record has been researched to <br />determine if the road easement exists. <br />The Administrator reported that he has looked at one of <br />the abstracts which does refer to a 12 1/2 foot road <br />easement. There is reference to a Book of Roads, <br />however, that book was lost in the 1940's. The <br />Administrator stated that there could be a significant <br />amount of leqal work involved in determining the <br />existence of the road easement, and the situation may <br />get down to the property owners rededicating the right- <br />of-way. <br />Scalze pointed out that Mr. Erickson at 777 Viking <br />Drive was the original town clerk, and may have some <br />knowledge of the matter. <br />Morelan felt the road easement matter may be a mute <br />point if it does not legally exist today, and asked if <br />the property owners were willing to dedicate the <br />easement. <br />Fahey felt that the fact that the easement once did <br />exist lends credence to their request for a 30 foot <br />right-of-way. Fahey felt it was clear from the <br />abstract that the easement is there. <br />Anderson reported that the property owners have met <br />with both the County and the State, and they are very <br />supportive in trying to work out something. MN DOT has <br />indicated that they will contact the City regarding a <br />cooperative project. State-Aid funding may be a <br />possibility. Anderson pointed out that if the City can <br />save dollars on the road project, then the property <br />owners will save money as well. Anderson felt it would <br />be possible to get the County to participate as well <br />since the County has provided maintenance services over <br />the years. <br />LaValle pointed out that the City used to contract with <br />the County for snow plowing service. <br />Anderson reported that in addition to snow plowing, the <br />County also provided basic street maintenance, tree <br />trimming, etc. Anderson felt that at one point the <br />street may have been a County road.
