MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 1995 <br />that MN DOT has indicated that they want to retain the <br />right-of-way where the southern street loop crosses, <br />however, MN DOT will allow the continued use of that <br />right-of-way. <br />Fahey suggested that the City Attorney verify whether <br />or not the 25 foot right-of-way exists, and that staff <br />pursue MN DOT participation in a road improvement <br />project. The Council could then consider whether or <br />not to allow a variance for a 30 foot road right-of-way <br />width, based upon a recommendation by staff. Fahey <br />suggested that pavement width be considered as well, <br />and that the Council may want a width wider than 15 <br />feet. <br />Anderson reported that the existing pavement is between <br />12 and 15 feet and has served its purpose for this <br />long. Anderson reported that the property owners want <br />to preserve the integrity of the neighborhood.and the <br />established home sites. There is limited traffic in <br />the neighborhood. <br />Morelan stated that the Attorney can look at whether or <br />not the 25-foot easement exists, but regardless the <br />Council should pursue one of the two options proposed <br />versus the homeowners' association. <br />Anderson reported that the homeowners~ association is <br />not an option. <br />Fahey asked if the property owners are willing to widen <br />the easement to 30 feet with the possibility of a 15 to <br />20 foot mat. Fahey pointed out that input is needed <br />from staff on these issues. <br />The City Administrator reported that staff understands <br />the concerns of the neighborhood, but at this point has <br />not studied the options in detail. <br />Anderson reported that at a February ist meeting with <br />staff, the 30 foot right-of-way width was discussed and <br />it appears would be wide enough to address the City's <br />concerns with regard to snow storage. The 30-foot <br />width also follows the existing 30-foot utility <br />easement. <br />Scalze asked if there was time to do a road improvement <br />in this area during 1995. <br />6 <br />
