MINUTES CITY COUNCIL FEBRUARY 22, 1995 SCHMIDT Mr. John Daubney, attorney representing Mr. John PROPERTY Ryan, appeared before the Council requesting approval DIVISION of the division of a small triangular piece of property from the Schmidt property located at 2718 Edgerton Street. Mr. Ryan, the adjacent property owner, will be purchasing the property and combininq it with his own. Fahey noted that the triangular piece of property will provide Mr. Ryan access to Keller Parkway. Mr. Morelan introduced the following resolution and moved its adoption: RESOLUTION N0. 95-2-52 - APPROVING THE SCHMIDT PROPERTY DIVISION FOR 2718 EDGERTON STREET AS REQUESTED SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE PLANNING COMMISSION The foregoing resolution was duly seconded by Pedersen. Ayes (5) Morelan, Pedersen, Fahey, Scalze, LaValle. Nays (0). Resolution declared adopted. CONCEPT PLAT- Mr. Bob Moser appeared before the Council requesting DENERY approval of a concept plat for development of the PROPERTY Denery property located at 3075 LaBore Road. Moser pointed out that since the Planning Commission meeting, he has submitted a third concept option which addresses concerns raised by the Planning Commission. Morelan pointed out that under the third option, the Denery property could be developed into seven lots. If the City chooses to trade adjacent park land, an additional two lots could be developed. The City Administrator reported that the Park & Recreation Commission felt a land trade was worthwhile provided the legalities could be worked out. Based upon the City Attorney's review it appears that the title to the park property is not restricted, therefore, a trade should be possible. However, there may be issues with the NSP easement to consider.
