MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 1995 <br />RESOLUTION 95-2-61 - EXTENDING THE MORATORIUM RELATIVE <br />TO TIF DISTRICT 3-1 FOR THE MAXIMUM PERIOD ALLOWED BY <br />STATE LAW WHICH IS BELIEVED TO BE 18 MONTHS FROM JULY <br />18~ 1995 UNLESS EARLIER TERMINATED. <br />The foreqoing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Scalze, LaValle, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Morelan asked if we can exempt properties from <br />moratorium provisions should development or maintenance <br />issues arise relative to that property. The City <br />Attorney confirmed it was possible to do so. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-2-62 - INSTRUCTING THE CITY ATTORNEY <br />AND CITY ADMINISTRATOR TO COMMENCE DISCUSSIONS FOR THE <br />POTENTIAL VOLUNTARY ACQUISITION OF THE GUERIN PROPERTY <br />LOCATED ON THE NORTHEAST CORNER OF RICE STREET AND <br />LITTLE CANADA ROAD WITH AN APPRAISAL TO BE OBTAINED TO <br />USE AS A BASIS FOR ACTUAL NEGOTIATIONS <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Scalze, LaValle, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Further discussion occurred regarding the Guerin <br />property. The merits of a long-term lease versus <br />purchase of the property were reviewed relative to the <br />City's need to control the site. <br />The City Attorney pointed out the process for <br />acquisition by condemnation. He indicated that an <br />appraisal was needed and then a resolution from the <br />Council authorizing condemnation. He also questioned <br />who should be undertaking the condemnation action; the <br />City or the EDA. <br />The moratorium for all B-3 property within the City <br />that is set to expire March lst was further discussed. <br />Mr. Carl Schroeder requested the Council to release his <br />property located just north of the Hardees site on Rice <br />Street so he can pursue its sale. The ABRA proposal <br />was also discussed. <br />Scalze pointed out that ABRA is not a permitted nor <br />3 <br />
