MINUTES <br />CITY COUNCIL <br />FEBRUARY 28, 1995 <br />Mayor Fahey also stated he has told Mr. Collyard that <br />we will be proceeding on our own to generate <br />development guidelines for the Rice Street/Little <br />Canada Road area, and that Mr. Collyard will be able to <br />submit proposals to the City for consideration as long <br />as they meet our development parameters. <br />The City Attorney stated that we adopted a moratorium <br />on all B-3 properties in the City on october 12, 1994. <br />On January 11, 1995, the Council extended the <br />moratorium for 41 days which would end on March 1st. <br />The Attorney reported that Statute allows for a <br />moratorium to be enacted for an initial term of one <br />year and further provides for an 18-month extension. <br />Given our first ordinance enactment has already <br />expired, we can extend for up to 18 months total <br />duration less the 41 days which has already passed. <br />The City Attorney presented two moratorium options. <br />They are as follows: <br />l. Extend the moratorium for all B-3 properties <br />as previously in effect. <br />2. Extend moratorium for all B-3 properties in <br />Redevelopment District No. 3. <br />The City Attorney explained we can make extensions <br />incrementally and continue that process up to the 18- <br />month total time limit less the 41 days already <br />utilized. <br />Council Member LaValle stated that if Mr. Schroeder has <br />a buyer for his property, we shouldn't unnecessarily <br />hold up that sale. <br />The City Attorney clarified that the legal description <br />for the extension of a moratorium in the redevelopment <br />area would be the Development District #3 boundaries. <br />Council Member Morelan reminded us of the existing <br />moratorium we enacted for Development District #3. <br />Staff confirmed that this was established in July of <br />1994. That moratorium was enacted for a one-year <br />period which is set to expire on July 18, 1995. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />2 <br />
