MINUTES <br />CITY COUNCIL <br />MARCH 8, 1995 <br />Moser reported that they are agreeable to a 10-foot <br />walkway easement. <br />Fahey suggested that the easement be incorporated into <br />the concept so that the developer is aware of this <br />requirement. <br />Moser asked about the drainage ditch easement which <br />runs through the park property and whether that <br />easement would be retained on park property or <br />incorporated into the lots to be sold to the developer. <br />The City Administrator suggested that the ditch <br />easement be incorporated into the lots, if possible. <br />The Administrator pointed out that the ditch would be <br />part of the rear yard setback area. However, he would <br />research the easement to determine if it is possible to <br />include this area as part of the lots. <br />Scalze asked if the procedure would be that an <br />appraisal is obtained and the land then sold to the <br />developer for its raw land value. <br />Moser replied that that was his understanding. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-3-69 - APPROVING THE CONCEPT <br />DEVELOPMENT PLAN FOR THE DENERY PROPERTY WHICH CONSISTS <br />OF NINE LOTS, INCLUDING ADJACENT CITY PARK PROPERTY TO <br />BE SOLD TO THE DEVELOPER AT RAW LAND VALUE, AS WELL AS <br />A TEN FOOT WALKWAY EASEMENT FROM THE END OF THE <br />PROPOSED CUL-DE-SAC TO THE ADJACENT PARK PROPERTY <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Scalze, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />Moser again asked if the drainage ditch area would be <br />included with the lots. <br />The City Administrator replied that that would be his <br />recommendation. However, he would have to research how <br />the drainage ditch easement is designated to determine <br />if it is possible. <br />Mr. Fahey introduced the following resolution and moved <br />3 <br />
