The Administrator suggested that he discuss the matter with Mr. Frattalone to determine if he is willing to accept the total cost of the improvement. If so, Mr. Frattalone would have to sign a Waiver of Right to Appeal Special Assessment for the amount indicated in the Engineer's report. There was no one from the general public present wishing to comment on this matter. Upon motion by Morelan, seconded by Scalze, the public hearing was closed. Mr. Morelan introduced the following resolution and moved its adoption: RESOLUTION NO. 95-3-68 - ORDERING IMPROVEMENT NO. 95-1 AS PROPOSED (OPTION 2A) SUBJECT TO MR. FRATTALONE SIGNING A WAIVER OF RIGHT TO APPEAL SPECIAL ASSESSMENT WITH THE UNDERSTANDING THAT SHOULD OTHER PROPERTY OWNERS CONNECT TO THE SEWER LINE IN THE FUTURE, THEY WOULD BE ASSESSED FOR THE IMPROVEMENT AT THAT TIME The foregoing resolution was duly seconded by LaValle. Ayes (5) Morelan, LaValle, Fahey, Scalze, Pedersen. Nays (0). Resolution declared adopted. CONCEPT PLAT- Bob Moser, representing Mrs. Denery, submitted a DENERY revised concept plat for development of the Denery PROPERTY property which includes adjacent City park property. Moser indicated that the developer who will purchase the raw land from Mrs. Denery is agreeable to purchasing adjacent park property to be included in the development. The next step would be for the City to have the property appraised to determine the raw land value. Fahey pointed out the triangular parcel that would be left near County Road D. Fahey felt that small piece would be of no value as park property and suggested that it be incorporated into the adjacent lot. Fahey also noted the need for a walkway easement from the end of the cul-de-sac to the park property. 2
