MINIITES <br />CITY COUNCIL <br />MARCA 8, 1995 <br />the improvement. <br />The City Administrator replied that Mr. Frattalone was <br />hoping the other property owners would be willing to <br />participate. The Administrator suggested that he <br />discuss the matter with Mr. Frattalone to determine if <br />he is willing to accept the total cost of the <br />improvement. If so, Mr. Frattalone would have to sign <br />a Waiver of Right to Appeal Special Assessment for the <br />amount indicated in the Engineer's report. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Morelan, seconded by Scalze, the public <br />hearing was closed. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-3-68 - ORDERING IMPROVEMENT NO. 95-1 <br />AS PROPOSED (OPTION 2A) SUBJECT TO MR. FRATTALONE <br />SIGNING A WAIVER OF RIGHT TO APPEAL SPECIAL ASSESSMENT <br />WITH THE UNDERSTANDING THAT SHOULD OTHER PROPERTY <br />OWNERS CONNECT TO THE SEWER LINE IN THE FUTURE, THEY <br />WOULD BE ASSESSED FOR THE IMPROVEMENT AT THAT TIME <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Fahey, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CONCEPT PLAT- Bob Moser, representing Mrs. Denery, submitted a <br />DENERY revised concept plat for development of the Denery <br />PROPERTY property which includes adjacent City park property. <br />Moser indicated that the developer who will purchase <br />the raw land from Mrs. Denery is agreeable to <br />purchasing adjacent park property to be included in the <br />development. The next step would be for the City to <br />have the property appraised to determine the raw land <br />value. <br />Fahey pointed out the triangular parcel that would be <br />left near County Road D. Fahey felt that small piece <br />would be of no value as park property and suggested <br />that it be incorporated into the adjacent lot. Fahey <br />also noted the need for a walkway easement from the end <br />of the cul-de-sac to the park property. <br />2 <br />
