MINi7TES <br />CITY COUNCIL <br />MARCH 22, 1995 <br />developing the site. <br />Mr. Pedersen introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-3-87 - ACCEPTING THE PROPOSAL OF THE <br />EHLERS/MAXFIELD/HOISINGTON KOEGLER GROUP FOR CREATION <br />OF A DEVELOPMENT GUIDE FOR THE RICE STREET/LITTLE <br />CANADA ROAD CORRIDOR <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Pedersen, LaValle, Fahey, Morelan, Scalze. <br />Nays (0). Resolution declared adopted. <br />RECESS At this point in the meeting, 8:30 P.M., Council took a <br />short recess. The meeting was reconvened at 8:40 P.M. <br />VOTES TO Fahey pointed out that according to the survey <br />APPROVE conducted by City staff, all the cities surveyed <br />VARIANCES require a simple majority to pass variances to both <br />their Zoning Ordinance and Subdivision Ordinance, with <br />the exception of Falcon Heights. Fahey pointed out the <br />discussion at the last meeting about the conflicting <br />language in the Subdivision Ordinance with regard to <br />the need for a simple or weighted majority in passing a <br />variance. The City's Zoning Code requires a weighted <br />majority in order to pass a variance. <br />The City Attorney affirmed that there is inconsistent <br />language in the Subdivision Ordinance with regard to <br />the vote required to pass a variance. <br />Fahey recommended that a simple majority be required <br />for approval of variances to both the Subdivision and <br />Zoning Ordinances. Fahey felt that there were adequate <br />standards which must be met in both ordinances to apply <br />variances requests against. Fahey felt that Little <br />Canada should be in conformity with what the <br />surrounding cities are doing and felt variance requests <br />would be handled more expeditiously if a majority vote <br />were required. <br />Pedersen asked if the City was required to have the <br />same vote requirement for both ordinances. <br />The City Planner stated that he was not aware of any <br />12 <br />
