MINUTES <br />CITY COUNCIL <br />APRIL 12, 1995 <br />1995 MN <br />STATE <br />BUILDING <br />CODE <br />CONTRACT <br />WITH EHLERS <br />GROUP <br />The foregoing resolution was duly secon~ied by LaValle. <br />Ayes (5) Scalze, LaValle, Fahey, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />The Council reviewed the recommendation of the <br />Building Inspector for adoption of the 1995 Minnesota <br />State Building Code. If adopted, the Code would become <br />effective upon publication. <br />Mr. LaValle introduced the £ollowing re:solution and <br />moved its adoption: <br />RESOLUTION NO. 95-4-101 - ADOPTING THE :1995 MINNESOTA <br />STATE BUILDING CODE AS RECOMMENDED BY T13E BUILDING <br />INSPECTOR <br />The foreqoing resolution was duly secon~9ed by Pedersen. <br />Ayes (5) LaValle, Pedersen, Morelan, Sc+~lze, Fahey. <br />Nays (0). Resolution declared adopted. <br />The City Administrator reviewed the contract with <br />Ehlers & Associates for development guide for the <br />Rice Street/Little Canada Road area. Tlze Administrator <br />pointed out that the contract contains ~~ retainage <br />clause which provides if the guide is not completed by <br />September Sth or an agreed upon amended date, retainage <br />would be forfeited by the Group. The contract also <br />contains a clause which provides for te:rmination at any <br />point in the process the City might fee.1 appropriate. <br />Another provision allows for the amendm~snt of the scope <br />of services without affecting the compensation schedule <br />unless mutually agreed upon. <br />LaValle suggested that there be some control over <br />meetinqs with interested developers from a time <br />standpoint. <br />The Administrator felt that control was in place. The <br />Administrator also reported that the EhLers Group is in <br />agreement with the provisions of the contract. <br />Mr. Morelan introduced the following re;~olution and <br />moved its adoption: <br />RESOLUTION N0. 95-4-102 - APPROVING THE CONTRACT WITH <br />EHLERS & ASSOCIATES, INC.
