MINUTES CITY COUNCIL APRIL 12, 1995 1995 MN STATE BUILDING CODE CONTRACT WITH EHLERS GROUP The foregoing resolution was duly secon~ied by LaValle. Ayes (5) Scalze, LaValle, Fahey, Pedersen, Morelan. Nays (0). Resolution declared adopted. The Council reviewed the recommendation of the Building Inspector for adoption of the 1995 Minnesota State Building Code. If adopted, the Code would become effective upon publication. Mr. LaValle introduced the £ollowing re:solution and moved its adoption: RESOLUTION NO. 95-4-101 - ADOPTING THE :1995 MINNESOTA STATE BUILDING CODE AS RECOMMENDED BY T13E BUILDING INSPECTOR The foreqoing resolution was duly secon~9ed by Pedersen. Ayes (5) LaValle, Pedersen, Morelan, Sc+~lze, Fahey. Nays (0). Resolution declared adopted. The City Administrator reviewed the contract with Ehlers & Associates for development guide for the Rice Street/Little Canada Road area. Tlze Administrator pointed out that the contract contains ~~ retainage clause which provides if the guide is not completed by September Sth or an agreed upon amended date, retainage would be forfeited by the Group. The contract also contains a clause which provides for te:rmination at any point in the process the City might fee.1 appropriate. Another provision allows for the amendm~snt of the scope of services without affecting the compensation schedule unless mutually agreed upon. LaValle suggested that there be some control over meetinqs with interested developers from a time standpoint. The Administrator felt that control was in place. The Administrator also reported that the EhLers Group is in agreement with the provisions of the contract.
