MINUTES <br />CITY COUNCIL <br />APRIL 26, 1995 <br />before action could be taken on the Tima property <br />division. <br />The City Administrator pointed out that an improvement <br />hearing would be necessary at the time the City <br />considers the reconstruction of Bluwood and Australian, <br />and the variance for the cul-de-sac could be granted at <br />that time. The Administrator reported that a project <br />must be constructed within one year of the date of the <br />improvement hearing. <br />Fahey suggested that the City accommodate Mr. Tima's <br />request and set up the process for a hearing on the <br />cul-de-sac. <br />The City Administrator clarified that he cannot answer <br />the question on right-of-way costs raised by Member <br />Scalze relative to assessments versus City supported. <br />That depends on what the project costs are and where <br />the City's assessment policy is at. <br />Kajalski stated that if the cul-de-sac is shifted too <br />far onto the Tima property, Mr. Tima would lose a lot. <br />The City Administrator pointed out that the discussion <br />is that the right-of-way would come approximately <br />equally from the Magnuson, Tima, and Morelan <br />properties. This would allow Mr. Tima to divide his <br />property into three lots. <br />LaValle asked if the Magnuson property would then <br />become non-conforming. <br />The City Planner replied that it would not. <br />Kajalski suggested that moving the cul-de-sac away from <br />the Magnuson property and more onto the Morelan <br />property was a good idea, since the Morelan's would <br />gain property through the vacation of Jackson Street. <br />This vacation could serve to compensate Morelan's for <br />the cul-de-sac right-of-way. <br />The City Administrator pointed out that the problem is <br />that the cul-de-sac right-of-way needed from the <br />Morelan property results in pushing a new home closer <br />to Morelan's existing home. <br />Fahey pointed out that the intention is to accommodate <br />14 <br />
