MINUTES <br />CITY COUNCIL <br />APRIL 26, 1995 <br />Mr. Tima and grant him lot split approval for three <br />lots with access via cul-de-sacs at the end of <br />Australian and Bluwood. City staff will work with the <br />three property owners at the end of Australian on the <br />placement of the cul-de-sac to try to come up with an <br />equitable solution. If those efforts are not <br />successful, the Council will have to decide the <br />placement of the cul-de-sac. <br />Scalze suggested that if Jackson Street right-of-way is <br />vacated, 7 feet should go to the Morelan property and 5 <br />feet to the Tima property. Scalze pointed out that the <br />difficult part is that the Maqnuson property has <br />nothing to gain, and dedication of right-of-way <br />decreases the Magnuson front yard area with the <br />property having little back yard. <br />Fahey stated that he was not in favor of taking any <br />more property from Magnuson's than from Morelan's. <br />Fahey felt the burden should be on the Tima property. <br />Scalze pointed out that no right-of-way is needed from <br />the Morelan property if Jackson Street is improved. <br />This would still give Tima two buildable lots. <br />Fahey stated that the Jackson Street improvement would <br />devalue the Morelan property. <br />Pedersen felt that the question is whether Magnuson's <br />are losing property or is property being taken for <br />right-of-way which should have been taken at the time <br />the house was built. <br />Scalze pointed out that there was no need to take <br />right-of-way for the cul-de-sac at the time the <br />Magnuson home was built since there was existing right- <br />of-way for Jackson Street. <br />Pedersen pointed out that Mr. Tima can split his <br />property if cul-de-sac right-of-way is obtained without <br />having to dedication an additional 7 feet of road <br />right-of-way for Jackson Street. <br />Steve Carrigon, realtor representing the Magnuson's, <br />pointed out that the Magnuson property is surrounded by <br />the railroad and by County Road C, and now the proposed <br />cul-de-sac. Carrigon felt the cul-de-sac would hurt <br />the value of the Magnuson property. Carrigon pointed <br />15 <br />
