MINUTES CITY COUNCIL APRIL 26, 1995 out that the Morelan property will pick up additional land should Jackson Street be vacated. Therefore, he suggested that the cul-de-sac be shifted away from the Magnuson property and more onto the Morelan property. Fahey stated that he did not see an equitable way to do that, and felt that all three property owners should participate in providing the cul-de-sac right-of-way. Fahey felt it was in the interest of the property owners to work the situation out. If not, then the cul-de-sac should be shared equally between the three properties. Fahey stated that he had more sympathy for the Magnuson's and Morelan's than for the Tima's. Fahey pointed out that the Tima's benefit from the lot split where none is required by Code. Corriqan stated that the cul-de-sac is nothing but a penalty to the Magnuson's while the other two properties gain from the improvement. The City Administrator stated that the Morelan property would not gain since the cul-de-sac impacts the constructability of their property. Pedersen stated that the Council must make a decision on this matter. It has the feelings of the neighborhood on the issue. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION N0. 95-4-110 - APPROVING THE TIMA PROPERTY DIVISION AS PRESENTED SUBJECT TO PLACEMENT OF A CUL-DE- SAC AT THE ENDS OF AUSTRALIAN AND BLUWOOD AVENUES AT THE TIME OF STREET RECONSTRUCTION, SUBJECT TO DEDICATION OF THE NECESSARY EASEMENTS FOR THE AUSTRALIAN CUL-DE-SAC RIGHT-OF-WAY TO THE CITY FROM THE MORELAN, TIMA, AND MAGNUSON PROPERTIES THROUGH NEGOTIATION OR CONDEMNATION, WITH EXACT POSITION OF TIiE CUL-DE-SAC TO BE DETERMINED UPON FURTHER STUDY BY CITY STAFF The foregoing resolution was duly seconded by LaValle. Ayes (4) Fahey, LaValle, Scalze, Pedersen. Nays (O). Abstentions (1) Morelan. Resolution declared adopted. 16
