MINUTES <br />CITY COUNCIL <br />APRIL 26, 1995 <br />out that the Morelan property will pick up additional <br />land should Jackson Street be vacated. Therefore, he <br />suggested that the cul-de-sac be shifted away from the <br />Magnuson property and more onto the Morelan property. <br />Fahey stated that he did not see an equitable way to do <br />that, and felt that all three property owners should <br />participate in providing the cul-de-sac right-of-way. <br />Fahey felt it was in the interest of the property <br />owners to work the situation out. If not, then the <br />cul-de-sac should be shared equally between the three <br />properties. Fahey stated that he had more sympathy for <br />the Magnuson's and Morelan's than for the Tima's. <br />Fahey pointed out that the Tima's benefit from the lot <br />split where none is required by Code. <br />Corriqan stated that the cul-de-sac is nothing but a <br />penalty to the Magnuson's while the other two <br />properties gain from the improvement. <br />The City Administrator stated that the Morelan property <br />would not gain since the cul-de-sac impacts the <br />constructability of their property. <br />Pedersen stated that the Council must make a decision <br />on this matter. It has the feelings of the <br />neighborhood on the issue. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 95-4-110 - APPROVING THE TIMA PROPERTY <br />DIVISION AS PRESENTED SUBJECT TO PLACEMENT OF A CUL-DE- <br />SAC AT THE ENDS OF AUSTRALIAN AND BLUWOOD AVENUES AT <br />THE TIME OF STREET RECONSTRUCTION, SUBJECT TO <br />DEDICATION OF THE NECESSARY EASEMENTS FOR THE <br />AUSTRALIAN CUL-DE-SAC RIGHT-OF-WAY TO THE CITY FROM THE <br />MORELAN, TIMA, AND MAGNUSON PROPERTIES THROUGH <br />NEGOTIATION OR CONDEMNATION, WITH EXACT POSITION OF TIiE <br />CUL-DE-SAC TO BE DETERMINED UPON FURTHER STUDY BY CITY <br />STAFF <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Fahey, LaValle, Scalze, Pedersen. <br />Nays (O). <br />Abstentions (1) Morelan. Resolution declared adopted. <br />16 <br />
