Resolution declared adopted. <br />SUPII2AMERICA The City Attorney reported that SuperAmerica has <br />LITIGATION filed an appeal relative to their litigation against <br />the City. The Attorney anticipated a decision on the <br />appeal by later summer or early fall. <br />GILANDERI/ The City Administrator reviewed the results of a survey <br />VIKING DR. send to Gilanderi/Viking Drive property owners <br />ROAD regarding street improvement options. The <br />IMPROVEMENT Administrator noted that six of the seven property <br /> owners prefer the looped street option which consists <br /> of 18 feet of paved surface to serve all driveways and <br /> 12 feet along Highway 36 right-of-way. Estimated cost <br /> of that option is $6,965 per lot. The City <br /> Administrator recommended that approval should be <br /> subject to the property owners signing Waivers of Right <br /> to Appeal Special Assessments, which would include <br /> street improvement costs, water main costs, and burying <br /> of electrical lines. The Administrator also <br /> recommended that an agreement be signed by property <br /> owners which would be recorded against the properties <br /> which spells out the standards of the road improvement. <br /> The Administrator reported that the dissenting property <br />18 <br />
