MINUTES CITY COUNCIL APRIL 26, 1995 owner preferred the second option, which included paving the dead-end street with 30 foot paved radius cul-de-sac located on the Lehner/Gawreluk properties immediately north of Highway 36 right-of-way. Street width would be 20 feet. Estimated cost $740 per lot. This third option is the same as Option 2 with the addition of curb and gutter. Estimated cost $2,475 per lot. The Administrator suggested that the City can pursue the State for more participation in the project, however, success is doubtful. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 95-4-112 - APPROVING THE IMPROVEMENT OF GILANDERI LANE/VIKING DRIVE WITH IMPROVEMENT TO CONSIST OF LOOPED STREET CONSISTING OF 18 FOOT PAVED SURFACE TO SERVE ALL DRIVEWAYS AND 12 FOOT PAVED SURFACE ALONG HIGHWAY 36 RIGHT-OF-WAY, SUBJECT TO RECEIPT OF WAIVERS OF RIGHT TO APPEAL SPECIAL ASSESSMENTS FROM THE PROPERTY OWNERS INVOLVED FOR ASSESSMENTS FOR ROAD, WATER MAIN, AND BURYING UTILITIES, SUBJECT TO THE PROPERTY OWNERS GRANTING THE NECESSARY EASEMENTS FOR THE PROJECT, SUBJECT TO THE CITY ATTORNEY RECONFIRMING EASEMENTS THAT MAY ALREADY EXIST, AS WELL AS DEDICATION OF ANY RIGHT-OF-WAY NECESSARY TO FACILITATE CONSTRUCTION The foreqoing resolution was duly seconded by LaValle. Ayes (5) Fahey, LaValle, Pedersen, Scalze, Morelan. Nays (0). Resolution declared adopted. Morelan asked if an improvement hearing was necessary for the street project. The City Administrator replied that if the City receives a petition for the street improvement, an improvement hearinq would not be necessary. The Administrator felt the biggest issue was getting a consensus of the property owners and Waivers of Right to Appeal Assessments. If Waivers are not obtained from 100% of the property owners, the Council will have to decided whether or not to proceed with the project.
