The fact that the City is planning to plant <br />over 100 trees during 1995 would make a better sub- <br />headline than the cutting down of one cottonwood tree. <br />Fahey thanked Scalze for the facts she provided and <br />agreed with her comments. <br />Mr. Pedersen introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-5-123 - APPROVING THE CONSENT AGENDA <br />WHICH CONTAINS THE FOLLOWING ITEMS: <br />*APPROVAL OF A PREMISES PERMIT FOR PULL TAB BOOTH AT <br />THE CANADIAN DAYS CELEBRATION AS REQUESTED BY THE <br />CANADIAN DAYS COMMITTEE~ <br />*APPROVAL OF THE VOUCHERS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Pedersen, LaValle, Fahey, Morelan, Scalze. <br />Nays (O). Resolution declared adopted. <br />MOVER'5 LaValle asked the City Attorney if there was an offer <br />WAREIIOUSE to settle from either party in the Mover's Warehouse <br />LITIGATION litigation. The City Attorney replied that there was <br />not to his knowledge. <br />AUSTRALIAN Fahey reviewed the City Administrator's memo dated <br />CUL-DE-SAC May 5th outlining the agreements reached with the <br />RECOMMENDA- affected property owners with regard to the Australian <br />TIONS cul-de-sac. <br />The City Administrator reported that another issue has <br />come up. When Australian Avenue is reconstructed in <br />the future, it will be necessary to drain the end of <br />the cul-de-sac. There is currently a drainage <br />structure on the southwest corner of the Magnuson <br />property on the railroad right-of-way. This appears to <br />be a viable outlet for draining the cul-de-sac. To <br />accommodate this, he has discussed the granting of <br />drainage easements with the Tima's and Magnuson's along <br />their shared property line. The Administrator <br />recommended that an additional two feet of easement be <br />taken from the Tima property, increasing that easement <br />to 8 feet in width. He also recommended that 8 feet of <br />drainage and utility easement be taken along the <br />
