The fact that the City is planning to plant over 100 trees during 1995 would make a better sub- headline than the cutting down of one cottonwood tree. Fahey thanked Scalze for the facts she provided and agreed with her comments. Mr. Pedersen introduced the following resolution and moved its adoption: RESOLUTION NO. 95-5-123 - APPROVING THE CONSENT AGENDA WHICH CONTAINS THE FOLLOWING ITEMS: *APPROVAL OF A PREMISES PERMIT FOR PULL TAB BOOTH AT THE CANADIAN DAYS CELEBRATION AS REQUESTED BY THE CANADIAN DAYS COMMITTEE~ *APPROVAL OF THE VOUCHERS The foregoing resolution was duly seconded by LaValle. Ayes (5) Pedersen, LaValle, Fahey, Morelan, Scalze. Nays (O). Resolution declared adopted. MOVER'5 LaValle asked the City Attorney if there was an offer WAREIIOUSE to settle from either party in the Mover's Warehouse LITIGATION litigation. The City Attorney replied that there was not to his knowledge. AUSTRALIAN Fahey reviewed the City Administrator's memo dated CUL-DE-SAC May 5th outlining the agreements reached with the RECOMMENDA- affected property owners with regard to the Australian TIONS cul-de-sac. The City Administrator reported that another issue has come up. When Australian Avenue is reconstructed in the future, it will be necessary to drain the end of the cul-de-sac. There is currently a drainage structure on the southwest corner of the Magnuson property on the railroad right-of-way. This appears to be a viable outlet for draining the cul-de-sac. To accommodate this, he has discussed the granting of drainage easements with the Tima's and Magnuson's along their shared property line. The Administrator recommended that an additional two feet of easement be taken from the Tima property, increasing that easement to 8 feet in width.
