MINU'PES <br />CITY COUNCIL <br />JUNE 13, 1995 <br />pool of candidates the City would have to consider for <br />a future job opening. <br />Fahey reported that the City would end up signing an <br />employment contract with the employee which would <br />indicate that initially the employee could be <br />terminated for cause, and after a period of time the <br />employee's status would change to at will. Other <br />benefits would be the same for the employee except for <br />the at will status. Fahey pointed out that some times <br />there are conflicts where employees do not work well <br />together. At will status makes it easier to deal with <br />these situations. <br />Scalze pointed out that the at will status would only <br />apply to future department heads. <br />Pedersen asked if there was a problem that would <br />necessitate the at will status for future department <br />heads. <br />Fahey replied that he did not see a problem, but was <br />being futuristic. Fahey pointed out that the City <br />Administrator is at will and has performed successfully <br />despite that status. <br />Scalze aqain indicated that at will employment is the <br />standard in most business settings. <br />Fahey indicated that at will employment status has <br />arisen because of some outrageous employment claims and <br />exposure to the employer in paying large damage <br />amounts. <br />The City Attorney reported the proposed personnel <br />policy could contain a provision which specifically <br />exempts department heads hired after a certain date. <br />Morelan asked if there would then be two personnel <br />handbooks. <br />The Attorney replied that there would be one handbook <br />which would specifically exempt department heads hired <br />after a certain date, and most likely a contract with <br />an at will department head spelling out conditions of <br />employment for that employee. <br />LaValle pointed out the human resources experience that <br />the Mayor has, and stated that he would defer to his <br />judgement. LaValle suggested that the Mayor and City <br />Attorney get together and discuss the issue and come <br />10 <br />
