MINUTES <br />CITY COUNCIL <br />Ji7NE 13, 1995 <br />back with a recommendation. <br />Scalze stated that she supported the at will employment <br />concept for future department heads, and suggested that <br />if three Council Members agree, the personnel policy be <br />revised accordinqly. <br />Fahey replied that the policy can be revised to include <br />that provision, or the City can simply do nothing and <br />address the matter at the time a new department head is <br />hired. Fahey pointed out that the City Attorney is <br />being conservative in protecting the rights of the City <br />given that this is such a litigious area. Fahey <br />indicated that even if an employee is at will, this is <br />not a license to be nonchalant with the employee's <br />rights. However, when dealing with the impact that an <br />employee can have on City services, the City wants to <br />be sure the employee is a good fit. <br />Fahey suggested the City adopt the recommendation made <br />by the City Attorney in his April 4th memo. Reference <br />to benefits for a future department head could be <br />addressed at the time an employment contract is drafted <br />with that future employee. <br />Morelan felt the at will issue could be handled simply. <br />It was a matter of whether or not the City wants to do <br />it. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 95-6-152 - ADOPTING THE RECOMMENDATION <br />OF THE CITY ATTORNEY WITH REGARD TO AT WILL EMPLOYMENT <br />PROVISION FOR FUTURE CITY DEPARTMENT HEADS AS OUTLINED <br />IN HIS LETTER DATED APRIL 4~ 1995 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Fahey, Scalze, LaValle, Pedersen. <br />Nays (1) Morelan. Resolution deolared adopted. <br />LAND Fahey reviewed the Planning Commission's discussion <br />AVAILABILITY- reqarding the two sites being considered for sale by <br />ST. PAUL the St. Paul Board of Water Commissioners, and their <br />BOARD OF recommendation to rezone the Rice Street site to PUD <br />WATER with an OPfice-Development designation, and the Spruce <br />COMMISSIONERS Street site to PUD with an I-P designation. <br />Scalze pointed out the recommendation of the Park & <br />Recreation Commission for a trail connection around the <br />11 <br />
