MINUTES <br />CITY COUNCIL <br />NLY 26, 1995 <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-7-180 - CALLING FOR A PUBLIC HEARING <br />FOR WEDNESDAY, AUGUST 23, 1995 AT 7:30 P.M. TO CONSIDER <br />AMENDMENT OF TI~IE ZONING CODE RELATIVE TO TEMPORARY <br />SIGNS <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Morelan, LaValle, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />SOLICITORS The Code Enforcement Officer submitted an amendment to <br />LICENSING the City's Solicitor Ordinance which he indicated would <br />provide City staff more flexibility and discretion in <br />regulating and overseeing the operations of solicitors <br />in the City. The Officer pointed out that the <br />ordinance requires solicitors to provide more detailed <br />information when applying for a license. The ordinance <br />also spells out prohibited activities and provides more <br />definition. <br />Morelan asked how many solicitor's licenses are issued <br />each year. <br />The Officer estimated that three have been issued in <br />the four months he has been on the job. He also <br />reported that the City does receive periodic complaints <br />about the activities of solicitors. <br />The Administrator estimated that 75% of the requests <br />for solicitor's licenses were from groups solicitinq <br />donations, and pointed out that the current ordinance <br />does not properly address this type of activity. <br />Morelan moved adoption of the revised Solicitor <br />Ordinance. Motion seconded by LaValle. <br />The City Attorney reported that this type of ordinance <br />typically gets a lot of play in the courts under the <br />First Amendment issue. The Attorney stated that he <br />would like to look at the ordinance in more detail <br />since there are rights granted to religious <br />organizations under the First Amendment. There are <br />also exemptions granted to political candidates. The <br />Attorney pointed out that this ordinance would apply to <br />organizations such as Girl Scouts and their cookie <br />sales. The Attorney stated that he was not sure the <br />Council wanted to ban those types of sales or require <br />licensing in those situations. <br />9 <br />
