MINUTES <br />CITY COUNCIL <br />SEPTENIBER 13, 1995 <br />Bob Leibel reported that he has reviewed the comparison <br />information gathered by City staff, and noted <br />particularly the one regarding the Brausen property. <br />The Planner's report for the Brausen variance request <br />noted that when a property line abuts a rear yard, that <br />property line is classified as a rear yard for setback <br />purposes. The setback for an accessory building from a <br />rear yard lot line is ten feet. Leibel stated that if <br />he is treated equally, then he should be allowed the <br />same rights as the Novak's would have. That is, a ten <br />foot setback for an accessory building from this shared <br />lot line. Leibel stated that he has no problem <br />providinq some screening of the garage from the Novak <br />property. <br />LaValle asked if the garage could be lined up with the <br />Leibel house. <br />Leibel replied that he looked at that option, and would <br />have to cut part of the patio off in order to place the <br />garage in line with his house. The would also require <br />a longer driveway. Leibel pointed out that the garage <br />would still be visible from the Novak property. <br />LaValle pointed out that the garage would not be in the <br />front yard. <br />Leibel again pointed out that the City Planner is <br />saying that the area where he is proposing to place the <br />garage should be treated as the rear yard. <br />Fahey stated that having looked at the site, there are <br />a couple of things that struck him. First, the Novak <br />house is significantly overbuilt for the lot. The City <br />approved a variance for the Novak's allowing them to <br />building within six feet of each side lot line. Fahey <br />also stated that there is some debate on the depth of <br />the Novak backyard. <br />Novak replied that his backyard has a depth of 30 feet. <br />Fahey pointed out that that is the absolute minimum. <br />Fahey noted that the Novak's built a home on a minimum- <br />sized lot and are now asking their neighbor not to <br />build because the qarage will interfere with the view <br />of the neighbor~s yard. Fahey pointed out that the <br />Leibel house sits to the west side of the property and <br />the east side is completely landscaped. Fahey reported <br />that he has reviewed the ordinance and studied the City <br />Planner's report and has concluded that there is a <br />difference between front yard and required front yard. <br />The front yard is defined as the property between the <br />3 <br />
