MINUTES <br />CITY COUNCIL <br />SEPTII+IDER 13, 1995 <br />Mayor Fahey proclaimed Monday, September 18, 1995 as <br />55+ Club Day in Little Canada in recognition of the 55+ <br />Club's 20th anniversary. <br />Morelan stated that on behalf of the City, he wanted to <br />thank the Canadian Days Committee for the job they did <br />last month with the Canadian Days Celebration. Morelan <br />also commented on the fire works which were set off in <br />recoqnition of the Little Canada Fire Department <br />Sunday, September lOth. Morelan stated that the <br />display was spectacular and a first-class job. <br />CUP FOR Mayor Fahey pointed out that the request for approval <br />SECOND of a Conditional Use Permit for a second garage made <br />GARAGE - by Bob and Jeanne Leibel for their property at 124 Twin <br />LEIBEL Lake Blvd. was tabled until this evening's meeting. <br /> Fahey pointed out the extensive background information <br /> that the Council has been presented with as well as the <br /> recommendation from the City Planner dated September <br /> 13th, which he summarized for those present. Fahey <br /> pointed out action taken by the Council approving the <br /> an addition to an existing accessory building in the <br /> front yard of the Quam property. Fahey suggested that <br /> if the Council feels that the definition of required <br /> front yard should be expanded to include the entire <br /> front yard, then the Quam action should be changed. <br /> Fahey noted that the public hearing was closed at the <br /> last meeting, but asked if there was anyone from the <br /> general public who wished to make additional comments <br /> on this matter. <br />Richard Novak stated that he could not understand the <br />rational that the Leibel's front yard was considered as <br />a back yard for setback purposes. Novak stated that if <br />the Council is of the mind to approve the CUP, he would <br />like to request that the matter be tabled one more time <br />so that he could have his attorney present so it can be <br />explained to him. If not, Novak indicated that he <br />would consider filing a lawsuit against the City. <br />Novak felt that approval of the CUP would be unfair <br />because two criteria outlined in the Code were not <br />being met. That is, the issue of the rear property <br />line, and the devaluation of adjacent property. Novak <br />stated that he did not feel the construction of a <br />garage on the Leibel property should cost him anything. <br />Novak felt the location proposed would make his already <br />small lot appear to be smaller. Novak indicated that <br />he wants to sell his property in the near future, and <br />felt the garage location proposed would devalue his <br />property. <br />2 <br />
