MINUTES CITY COUNCIL SEPTEMBER 27~ 1995 PROPERTY, AND THAT TAE PARK & RECREATION COMMISSION'S RECOMMENDATION IS FOR EVENTUAL DEVELOPMENT OF A NEIGHBORHOOD PARK ON THE MCN~MARA PROPERTY The foregoing resolution was duly seconded by LaValle. Ayes (5) Scalze, LaValle, Fahey, Morelan, Pedersen. Nays (0). Resolution declared adopted. Morelan suggested that the sale price for the trapezoid piece be based on the appraised value of the portion of the McNamara property that the City would obtain for a neighborhood park. Morelan suggested that the appraisal of the trapezoid piece could be used as a guideline. Aowever, that appraisal should not lock the City into the sale price. The City Administrator suggested that if a survey is sent out and no concern is expressed about the City's selling the property, an appraiser would be retained and negotiations would begin. Fahey suggested that consideration be given to the square footage of each parcel - the trapezoid piece as well as the portion of the McNamara property which would be needed. The values may be comparable given that the trapezoid piece is zoned commercial. Fahey asked that the Administrator report back to the Council. SUPERAMERICA The City Attorney reviewed his letter of September 25th LITIGATION regarding the SuperAmerica litigation. The court has until December 19, 1995 to make a decision on the matter. PUBLIC WORKS Mr. Fahey introduced the following resolution and SUPERINTENDENT moved its adoption: RESOLUTION N0. 95-9-227 - ACCEPTING THE RESIGNATION OF DAVE HARRIS AS PUBLIC WORKS SUPERINTENDENT WITH REGRETS, AND AUTHORIZING THE CITY ADMINISTRATOR TO ADVERTISE FOR A REPLACEMENT The foregoing resolution was duly seconded by LaValle. Ayes (5) Fahey, LaValle, Pedersen, Morelan, Scalze. Nays (0). Resolution declared adopted. ADJOURN Mr. LaValle introduced the following resolution and moved its adoption: 16
