MINUTES <br />CITY COUNCIL <br />SEPTEMBER 27, 1995 <br />Variance should be honored in the future. <br />The City Administrator reported that in mapping out the <br />exact size of the variance, it was determined that the <br />variance should be to allow an 8 foot encroachment <br />rather than the 7.5 feet initially recommended. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Scalze, the public <br />hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-9-222 - APPROVING A VARIANCE TO ALLOW <br />SETBACK ENCROACHMENT OF 8 FEET TOWARD THE DEDICATED <br />EASEMENT FOR THE AUSTRALIAN AVENUE CUL-DE-SAC FOR <br />PROPERTY LOCATED AT 109 BLUWOOD AVENUE, AND INDICATING <br />THAT IT IS THE CITY COUNCIL~S INTENT THAT THE VARIANCE <br />BE PERPETUAL IN NATURE SINCE IT WAS NEGOTIATED AS PART <br />OF DEDICATION OF THE AUSTRALIAN AVENUE CUL-DE-SAC <br />EASEMENT, ALSO INDICATING THAT SxOULD VARIANCE APPROVAL <br />LAPSE, THE APPLICATION FEE FOR A NEW APPLICATION WOULD <br />BE WAIVED <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) LaValle, Scalze, Fahey, Pedersen. <br />Nays (O). <br />Abstentions (1) Morelan. Resolution declared adopted. <br />ZONING Fahey opened the public hearing to consider amending <br />CODE the Zoning Code to prohibit the stockpiling and <br />AMENDMENT recycling of aggregate materials in supplies of more <br />STOCKPILING than twenty-five cubic yards in the I-P District. <br />OF AGGREGATE Fahey pointed out that this provision already exists <br />MATERIALS in the I-1 District. This ordinance would make the two <br />districts compatible. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Mrs. Scalze introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 421 - AMENDING SECTION 918.020. OF THE <br />ZONING CODE OF THE CITY OF LITTLE CANADA, RELATING TO <br />PERMITTED USES IN AN "I-P", INDUSTRIAL PARK ZONING <br />DISTRICT <br />6 <br />
