MINUTES <br />CITY COUNCIL <br />OCTOBER 11, 1995 <br />Fahey pointed out that the City's assessment policy was <br />challenged once and held up in court. The City put a <br />lot of time, effort, and debate into its assessment <br />policy, and does apply the policy uniformly. Fahey <br />pointed out that the City has had citizens say that the <br />new policy is not fair since the City is not assessing <br />as much as it used to. Fahey acknowledged that not <br />everyone is happy with the policy, but the Council has <br />tried to be consistent with the way it treats people. <br />Fahey noted that there is no good reason to delay <br />assessing the improvement pointing out that to do so <br />would only add cost to the assessment. <br />The City Administrator reported that he walked the job <br />yesterday with the Public Works Superintendent, the <br />City Engineer's Project Manager, and Valley Paving. A <br />punchlist of items to be corrected was compiled. There <br />is a problem at the intersection of Lakeshore and <br />Bluwood which must be addressed. The final lift of <br />asphalt will resolve a lot of the drainage issues. <br />However, the project was constructed to design <br />specifications. <br />Fahey noted that the final lift of asphalt will be <br />installed next year after patching is completed and the <br />road allowed to settle over the winter. <br />Scalze pointed out that it is typical that the final <br />lift be put on the following year. That way any <br />settling problems can be corrected prior to the final <br />lift. <br />Morelan stated that he has not been satisfied with the <br />work done on the project. However, there is still time <br />to salvage the project and make it a good one. To <br />date, the project has not been good. <br />Frison replied that this is why there is concern in <br />being assessed for a project six months in advance of <br />its completion. Frison suggested that the contractor <br />receive no more payments until corrections are made. <br />The City Administrator reported that the City is <br />holding a substantial pay request until punch list <br />items are completed. <br />Fahey suggested that it is hoped most of these problems <br />will be corrected prior to the assessment hearing. <br />Rocky Waite reported that he has been watching the <br />project closely. Waite reported that he was promised <br />17 <br />
