MINi7TES <br />CITY COUNCIL <br />OCTOBER 11, 1995 <br />that the storm sewer system would be a good one. <br />However, after a rain his yard and area across the <br />street is filling up with water. Water is running <br />through Bill Hastings yard and not into the storm sewer <br />system. After a good rain, the intersection is under <br />water. Waite reported that the system is not working <br />properly, and run-off is flowing through private yards. <br />From the railroad, the water is flowing so fast that it <br />flows right over the top of the pipe. Waite reported <br />that he was told this would be corrected when the final <br />lift of asphalt is put on, however, he believes the <br />situation will get worse. <br />Waite reported that in patching the street, Valley <br />Paving patches some areas, but then goes right by <br />others. Waite also reported that there is a culvert <br />that no one seems to know anything about. Waite was <br />concerned that eventually Valley Paving will be paid, <br />and the property owners in the area will be stuck with <br />the road. Waite felt that in a few years after the <br />road settles, there will be a real mess. Waite <br />encouraged the Council not to pay Valley Paving until <br />all the problems are corrected. <br />The City Administrator reported that Mr. Waite has met <br />with the City Engineer~s Project Manager a few times. <br />The last report was that Mr. Waite was going to contact <br />the Project Manager for a meeting to address issues Mr. <br />Waite has raised. However, he has not done this. The <br />Administrator reported that the final lift of asphalt <br />will make a difference in how the storm sewer works. <br />Fahey pointed out that the City must rely on the City <br />Engineer to make sure any problems with the project are <br />corrected. <br />Scalze asked how long after the final lift is installed <br />before the City makes final payment to Valley Paving. <br />The City Administrator reported that final payment will <br />be made once the City accepts the project. There will <br />then be a one year warranty on the work as well as a <br />performance bond this City holds. The City hold 5% of <br />each pay request as retainage on the project as well as <br />the cost of work not completed. <br />Morelan asked what the City's recourse is if there is a <br />design problem. <br />The City Administrator replied that that would be a <br />professional liability issue for the engineer. <br />18 <br />
