MINUTES CITY COUNCIL OCTOBER 24, 1995 LaValle noted that the City Council spent many months working on this assessment policy. The assessment policy has been upheld in court, and LaValle did not believe the policy should be changed at this point in time. Pedersen acknowledged that in creating a policy that would be fair, the Council created a policy that is not easy to understand. Mr. Martin pointed out that their lot has less than 75 feet of frontage, and they are being assessed for 85 feet. LaValle suggested that Mr. and Mrs. Martin discuss that issue with the City Administrator. The City Administrator explained that the odd-shaped lot formula was applied for the Martin property. The Administrator offered to review that calculation with Mr. and Mrs. Martin. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION N0. 95-10-241 - DENYING THE OBJECTIONS RECEIVED ON THE ASSESSMENT ROLL FOR IMPROVEMENT N0. 93- 11, JACKSON/OLD COUNTY ROAD C/LAKESHORE, BASED ON THE COUNCIL'S OPINION THAT THE APPLICATION OF THE CITY'S ASSESSMENT POLICY WAS DONE IN A FAIR AND CONSISTENT MANNER The foregoing resolution was duly seconded by LaValle. Ayes (5) Scalze, LaValle, Morelan, Pedersen, Fahey. Nays (0). Resolution declared adopted. IMP. NO. Fahey opened the public hearing to consider the 93-13 - assessment of Improvement No. 93-13, Lake Street lying LAKE STREET between Jackson Street on the west and Lakeshore Avenue on the east by street reconstruction, concrete curb and gutter, and storm drainage facilities. The City Engineer reported that he would like to address the execution of the contract as well as quality concerns. The Engineer reported that a project delay was experienced due to the gas company changing their method of operation once the project was underway. The gas company did a total replacement of the pipeline in the street, which was not anticipated at the time the project was bid, and which resulted in 17
