MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1995 <br />LaValle noted that the City Council spent many months <br />working on this assessment policy. The assessment <br />policy has been upheld in court, and LaValle did not <br />believe the policy should be changed at this point in <br />time. <br />Pedersen acknowledged that in creating a policy that <br />would be fair, the Council created a policy that is not <br />easy to understand. <br />Mr. Martin pointed out that their lot has less than 75 <br />feet of frontage, and they are being assessed for 85 <br />feet. <br />LaValle suggested that Mr. and Mrs. Martin discuss that <br />issue with the City Administrator. <br />The City Administrator explained that the odd-shaped <br />lot formula was applied for the Martin property. The <br />Administrator offered to review that calculation with <br />Mr. and Mrs. Martin. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-10-241 - DENYING THE OBJECTIONS <br />RECEIVED ON THE ASSESSMENT ROLL FOR IMPROVEMENT N0. 93- <br />11, JACKSON/OLD COUNTY ROAD C/LAKESHORE, BASED ON THE <br />COUNCIL'S OPINION THAT THE APPLICATION OF THE CITY'S <br />ASSESSMENT POLICY WAS DONE IN A FAIR AND CONSISTENT <br />MANNER <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Morelan, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />IMP. NO. Fahey opened the public hearing to consider the <br />93-13 - assessment of Improvement No. 93-13, Lake Street lying <br />LAKE STREET between Jackson Street on the west and Lakeshore Avenue <br />on the east by street reconstruction, concrete curb and <br />gutter, and storm drainage facilities. <br />The City Engineer reported that he would like to <br />address the execution of the contract as well as <br />quality concerns. The Engineer reported that a project <br />delay was experienced due to the gas company changing <br />their method of operation once the project was <br />underway. The gas company did a total replacement of <br />the pipeline in the street, which was not anticipated <br />at the time the project was bid, and which resulted in <br />17 <br />
