MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1995 <br />the sewer contractor indicated that it is typical to <br />have a back-up when a construction project is underway. <br />McDonough reported that it cost him $100 to $150 to <br />have the sewer line cleaned. <br />Mrs. McDonough asked when the new assessment policy was <br />adopted, again pointing out that at the improvement <br />hearing they were told their property would be assessed <br />for 75 feet of frontage. <br />Morelan replied that the new policy was adopted July <br />12, 1995. <br />The City Administrator pointed out that in changing the <br />policy, the Council looked for a more equitable <br />treatment of odd-shaped lots in relation to other lots. <br />The Administrator also pointed out that the assessment <br />policy set a cap on the maximum assessment rate. <br />Nagle felt that the McDonough's have been unfairly <br />treated in the process. Nagle recommended an exception <br />to the policy for their situation. <br />Fahey stated that the City must apply the policy <br />consistently. <br />Nagle quoted the from the contract wording dealing with <br />the completion of the project as well as penalties if <br />completion dates are not met. <br />Fahey again stated that he would be in favor of <br />rebating liquidated damages to property owners less any <br />attorneys fees to recover those damages. <br />Florence Dousi, 155 Lake Street, asked about a senior <br />citizen deferment. <br />The City Administrator reported that he would get Dousi <br />the appropriate form. <br />Mrs. Dousi reported that she dedicated the easement for <br />Lake Street approximately 21 years ago. Dousi stated <br />that she was not paid for that easement, although she <br />understands that others have been paid for dedicating <br />street easements. <br />The City Administrator reported that typically we try <br />not to pay compensation for easements. However, <br />circumstances can vary. <br />Dousi asked if there was anything that could be done at <br />this point about compensating her for the easement. <br />27 <br />
