MINUTES CITY COUNCIL OCTOBER 24, 1995 The City Administrator estimated that date at May 17th. Mrs. McDonough pointed out that when the project started, the assessment policy provided that she be assessed for 75 feet of frontage. After the project was began, the policy changed and now the City is proposing to assess her for 125 feet. The City Administrator replied that there is not a direct relationship between the total estimated cost of the project as determined by the bids and how the project is assessed. The issue is the change of policy and how it impacted the McDonough property. Nagle explained to McDonough that how the cost of the project and what individual property owners pay are separate issues. Fahey pointed out that the assessment policy was changed in July and may be change again in the future. There was no one else from the general public present wishing to comment on this matter. Upon motion by LaValle, seconded by Pedersen, the public hearing was closed. The Administrative Assistant read the list of written objections that the City has received for the Lake Street assessment. These are: Raymond Buchholz, 120 East Lake Street; Donald & Carol Cook, 109 East Lake Street; Florence Dousi, 155 East Lake Street; Harold Feickert, 2590 Jackson Street; John P. Johnson (Yarosevich), 155 E. Lake Str Austin & Barbara McDonough, 164 E. Lake Str.; Charles Nagle, 145 E. Lake Street. Mr. LaValle introduced the following resolution and moved its adoption: RESOLUTION NO. 95-10-242 - REJECTING THE OBJECTIONS RECEIVED FOR THE LAKE STREET IMPROVEMENT BASED UPON THE CITY COUNCIL~S POSITION THAT THE ASSESSMENT POLICY IS BEING APPLIED IN A FAIR AND EQUITABLE MANNER The foregoing resolution was duly seconded by Scalze. Ayes (5) LaValle, Scalze, Fahey, Pedersen, Morelan. Nays (0). Resolution declared adopted. 30
