MINUTES <br />CITY COUNCIL <br />OCTOBER 24, 1995 <br />The City Administrator estimated that date at May 17th. <br />Mrs. McDonough pointed out that when the project <br />started, the assessment policy provided that she be <br />assessed for 75 feet of frontage. After the project <br />was began, the policy changed and now the City is <br />proposing to assess her for 125 feet. <br />The City Administrator replied that there is not a <br />direct relationship between the total estimated cost of <br />the project as determined by the bids and how the <br />project is assessed. The issue is the change of policy <br />and how it impacted the McDonough property. <br />Nagle explained to McDonough that how the cost of the <br />project and what individual property owners pay are <br />separate issues. <br />Fahey pointed out that the assessment policy was <br />changed in July and may be change again in the future. <br />There was no one else from the general public present <br />wishing to comment on this matter. <br />Upon motion by LaValle, seconded by Pedersen, the <br />public hearing was closed. <br />The Administrative Assistant read the list of written <br />objections that the City has received for the Lake <br />Street assessment. These are: <br />Raymond Buchholz, 120 East Lake Street; <br />Donald & Carol Cook, 109 East Lake Street; <br />Florence Dousi, 155 East Lake Street; <br />Harold Feickert, 2590 Jackson Street; <br />John P. Johnson (Yarosevich), 155 E. Lake Str <br />Austin & Barbara McDonough, 164 E. Lake Str.; <br />Charles Nagle, 145 E. Lake Street. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-10-242 - REJECTING THE OBJECTIONS <br />RECEIVED FOR THE LAKE STREET IMPROVEMENT BASED UPON THE <br />CITY COUNCIL~S POSITION THAT THE ASSESSMENT POLICY IS <br />BEING APPLIED IN A FAIR AND EQUITABLE MANNER <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Fahey, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />30 <br />
