MINUTES CITY COUNCIL OCTOBER 25, 1995 on notice of the City~s intentions. Additional dollars realized from the trapezoid parcel sale can purchase additional land over the land realized from the 10% dedication. Morelan felt the City should continue negotiations with McNamara to acquire the 10% land dedication prior to the development of the site. Fahey noted that the City does not want to pay a premium for the land. Scalze suggested an option may be to have McNamara make his 100 land dedication at this time, rather than at the time the site develops. Fahey noted that the 10o requirement gives the City more leverage. Fahey also suggested that fencing of the easement area be negotiated as part of Mr. Rue's purchase of the trapezoid parcel. Morelan suggested that the fencing issue be discussed by the Park & Recreation Commission. Scalze asked if the trapezoid parcel needed to be rezoned to Industrial. The City Planner replied that the parcel is already zoned Industrial. Mr. Morelan introduced the following resolution and moved its adoption: RESOLUTION N0. 95-10-251 - AUTHORIZING CITY STAFF TO PROCEED WITH THE SALE OF THE TRAPEZOID PARCEL TO MR. DON RUE, NEGOTIATING WITH MR. RUE THE FENCING OF THE WALKWAY EASEMENT TO THE WATER WORKS PROPERTY IF RECOMMENDED BY THE PARK & RECREATION COMMISSION, AND FURTAER DIRECTING CITY STAFF TO CONTINUE NEGOTIATIONS WITH MR. MCNAMARA TO OBTAIN REPLACEMENT PARK PROPERTY FROM HIS PARCEL WITH THE OPTION OF A LAND DEDICATION AT THIS TIME TO SATISFY THE 10o LAND DEDICATION REQUIREMENT THAT WOULD BE MADE AT THE TIME TxE PARCEL IS DEVELOPED The foregoing resolution was duly seconded by LaValle.
