MINUTES <br />CITY COUNCIL <br />OCTOBER 25, 1995 <br />on notice of the City~s intentions. Additional dollars <br />realized from the trapezoid parcel sale can purchase <br />additional land over the land realized from the 10% <br />dedication. <br />Morelan felt the City should continue negotiations with <br />McNamara to acquire the 10% land dedication prior to <br />the development of the site. <br />Fahey noted that the City does not want to pay a <br />premium for the land. <br />Scalze suggested an option may be to have McNamara make <br />his 100 land dedication at this time, rather than at <br />the time the site develops. <br />Fahey noted that the 10o requirement gives the City <br />more leverage. Fahey also suggested that fencing of <br />the easement area be negotiated as part of Mr. Rue's <br />purchase of the trapezoid parcel. <br />Morelan suggested that the fencing issue be discussed <br />by the Park & Recreation Commission. <br />Scalze asked if the trapezoid parcel needed to be <br />rezoned to Industrial. <br />The City Planner replied that the parcel is already <br />zoned Industrial. <br />Mr. Morelan introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-10-251 - AUTHORIZING CITY STAFF TO <br />PROCEED WITH THE SALE OF THE TRAPEZOID PARCEL TO MR. <br />DON RUE, NEGOTIATING WITH MR. RUE THE FENCING OF THE <br />WALKWAY EASEMENT TO THE WATER WORKS PROPERTY IF <br />RECOMMENDED BY THE PARK & RECREATION COMMISSION, AND <br />FURTAER DIRECTING CITY STAFF TO CONTINUE NEGOTIATIONS <br />WITH MR. MCNAMARA TO OBTAIN REPLACEMENT PARK PROPERTY <br />FROM HIS PARCEL WITH THE OPTION OF A LAND DEDICATION AT <br />THIS TIME TO SATISFY THE 10o LAND DEDICATION <br />REQUIREMENT THAT WOULD BE MADE AT THE TIME TxE PARCEL <br />IS DEVELOPED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Scalze, Fahey, Pedersen. <br />Nays (0).
