MINUTES CITY COUNCIL NOVEt4BER 8, 1995 Mr. Fahey introduced the following ordinance and moved its adoption: ORDINANCE N0. 422 - AMENDING CHAPTER 1101.050. RELATING TO LICENSING OF DOGS AND CATS, REMOVING THE REQUIREMENT FOR THE LICENSING OF CATS, AND ADDING A PROVISION LIMITING THE NUMBER OF CATS PER DWELLING UNIT TO THREE AND COMBINATION NUMBER OF DOGS AND CATS PER DWELLING UNIT TO FOUR The foregoing ordinance was duly seconded by LaValle. Ayes (4) Fahey, LaValle, Scalze, Pedersen. Nays (1) Morelan. Ordinance declared adopted. SUPEI2AMERICA The City Attorney reported that the court upheld the LAWSUIT decision in the SuperAmerica lawsuit in favor of the City and affirmed dismissal pursuant to the City's motion for summary judgment. SuperAmerica now has until December 7th to petition for review by the Supreme Court. Granting of the petition is discretionary by the Supreme Court so there is no guarantee that the case will be heard. HOLIDAY Morelan reported that last year he raised the LIGHTS suggestion of holiday lights at City Hall. Given the time of the year, the issue was not pursued. Morelan suggested that if the City were willing to allocate funding for lights, he could find volunteers to put them up. Fahey stated that he did not believe holiday lights were a good use of tax dollars and would open the City up to criticism. Morelan felt the lighting was a community pride issue, and pointed out the dollars spend by the Community Pride Committee on City entrance signs. Fahey stated that he is on the Community Pride Committee and the issue of holiday lighting has not been discussed. Fahey stated that the Committee focuses on things with lasting impact, and even if the Committee recommended in favor of the lights, he would feel the same way. DOG AND CAT The Administrator clarified for the Council that the ORDINANCE existing Dog and Cat Ordinance requires the licensing of cats, and the recommendations for change to the 9
