The plaintiff also has the <br />option of appealing to the U.S. Supreme Court and has <br />90 days from December 7th to make that appeal. <br />ARCHITECTURI~I, Fahey noted that a joint workshop of the Council and <br />DESIGN Planning Commission was held on December 14th for a <br />GUIDELINES final review of Architectural Design Guidelines for the <br />Rice Street/Little Canada Road area. The Planning <br />Commission has now passed those guidelines on to the <br />Council for adoption: <br />Fahey asked if the Council has any additional comments <br />on the Guidelines. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-12-299 - ADOPTING THE RICE <br />STREET/LITTLE CANADA ROAD ARCHITECTURAL DESIGN <br />GUIDELINES AS RECOMMENDED BY THE PLANNING COMMISSION <br />AND AS SUBMITTED BY THE CITY PLANNER <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Pedersen, Fahey. <br />Nays (O). Resolution declared adopted. <br />EXEMPTION Mr. LaValle introduced the following resolution and <br />FROM moved its adoption: <br />MORATORIUM- <br />MARKETPLACE RESOLUTION NO. 95-12-300 - EXEMPTING THE MARKET PLACE <br />SHOPPING SHOPPING CENTER FROM THE BUILDING MORATORIUM IN THE <br />CENTER B-3 ZONING DISTRICT TO ALLOW ISSUANCE OF A BUILDING <br />PERMIT FOR REHABILITATION OF THE SHOPPING CENTER <br />The foregoing resolution was duly seconded by Morelan <br />Ayes (4) LaValle, Morelan, Fahey, Pedersen. <br />Nays (0). Resolution declared adopted. <br />CALL PUBLIC The City Planner recommended that the properties <br />HEARING TO within the Rice Street/Little Canada Road redevelopment <br />CONSIDER area be rezoned to Planned Unit Development regardless <br />REZONING of their current zoning. This will give the Council <br />OF RICE more control in ensuring that the criteria of the <br />STREET/ Development Guide for the area can be met when the <br />LITTLE Council is considering development proposals. The <br />CANADA RD. Planner reported that most of the properties within <br />REDEVELOPMENT the area are zoned B-3. However, some are zoned B-2 <br />and <br />20 <br />
