MINUTES <br />CITY COUNCIL <br />DECEMBER 20, 1995 <br />an ordinance on the books which is enforced, there is <br />no liability to the City. However, if the City is not <br />enforcing its ordinance, there may be some liability <br />incurred. <br />Council noted that a limited number of cities license <br />taxicabs, and reviewed the procedures followed by these <br />cities. Based on that review, LaValle recommended that <br />the ordinance be repealed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 95-12-298 - INSTRUCTING TIiE CITY <br />ATTORNEY TO PREPARE AN ORDINANCE AMENDMENT REPEALING <br />TAXI CAB LICENSING IN THE CITY OF LITTLE CANADA <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4). LaValle, Morelan, Pedersen, Fahey. <br />Nays (0). Resolution declared adopted. <br />SENIOR The City Attorney presented a proposed ordinance <br />DEFERMENT which requires that senior citizen deferments must <br />OF ASSESSMENTS meet certain low income guidelines in order to qualify <br />for approval. This ordinance is being presented based <br />on discussion at a previous Council meeting. <br />Mr. LaValle introduced the following ordinance and <br />moved its adoption: <br />ORDINANCE NO. 424 - AMENDING SECTION 2901.020 OF THE <br />MUNICIPAL CODE OF THE CITY OF LITTLE CANADA, RELATING <br />THE THE DEFERRAL OF SPECIAL ASSESSMENTS <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (3) LaValle, Pedersen, Fahey. <br />Nays (1) Morelan. Resolution declared adopted. <br />Morelan indicated that he is voting against the change <br />in ordinance believing that the ordinance was fine the <br />way it was. <br />SUPERAMERICA The City Attorney reported that SuperAmerica has <br />& MOVER'S petitioned the Minnesota Supreme Court to review <br />WAREHOUSE the decision of the Appellate and District Court. <br />LITIGATION A response should be due by the end of December. <br />With regard to the Mover's Warehouse litigation, The <br />8th Circuit Court has affirmed the decision of the <br />Federal District Court.
