MINUTES <br />CITY COUNCIL <br />MAY 14, 2025 <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />CONSIDER MINOR SUBDIVISION AND VARIANCE AT 49 OLD COUNTY ROAD C EAST <br />The Community Development Director presented a request for a minor subdivision and variance <br />request at 49 Old County Road C East and 50 County Road C East. He provided background <br />information on the two properties, which are owned by members of the same family. He stated that the <br />proposal would shift the property line eight feet to the south, which would be done through a minor <br />subdivision/boundary line adjustment. He noted the related variance for the property at 49 Old County <br />Road C for rear setback and lot depth variances. He explained that the owner of 49 Old County Road <br />C will be moving, and the owner of 50 County Road C would like to ensure preservation of the mature <br />trees that are along the shared rear property line. He noted that neither of the lots conforms with the <br />rear yard setback currently, as they were developed prior to the existing requirements. He stated that if <br />the Council supports the variance requests, staff recommends approval of the minor subdivision. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />There were no comments from the public. Upon motion by Kwapick, seconded by Miller, the public <br />hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Miller asked if there is anything that could be impacted by the reduced lot depth as a result of the <br />variance. The Community Development Director stated that if the property owner desired to have an <br />addition on the rear of the home, they would need to come back to request a new variance. He stated <br />that there would be room to expand to the east if they desired. He stated that the home has existed for <br />40 years and did not anticipate new development, but noted that any additional deviations would <br />require a new variance. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2025-5-70 — APPROVING THE MINOR SUBDIVISION FOR 49 OLD <br />COUNTYROAD CAND 50 COUNTYROAD <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2 025-5- 71—APPROVING THE VARIANCE FORA REAR SETBACK <br />TO BE 30 FEET WHEN 40 FEET IS REQUIRED AT 49 OLD COUNTYROAD C WITH <br />THE FINDINGS OF FA CT O UTLINED IN THE STAFF REPOR T <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5).
